        Hello,

        I moved to Bangalore in Jan 2024. I rented out a fully furnished 1bhk for 17.5k and 1L deposit. As per the rental agreement, rent date is 4th of every month.

        The building was in pathetic state as the owner did not care about maintenance or cleaning the same.

        Last summer, I requested the owner if I could rent an AC, he said yes but since the apartment was on the third floor there was no sunside or balcony to keep the outdoor unit (this was a requirement for companies like rentomojo).

        The owner offered his old AC and since he was into construction, he had his workers do some jugaad to keep the outdoor unit outside the window. Still installation costed us 9k of which half was beared by the owner.

        This was in April 2024, and from then owner asked extra 2.5k per month for the AC. However, I was able to negotiate it down to 1.5k and there after my rent was 19k (this was not updated in the contract).

        Every month since I moved it, the owner would call me on 29th or 30th of the previous month requesting for rent (Actual rent day 4th of the month) and I have always paid up whenever he asked.

        I was always looking out for better places to stay but the last push came when he decided to give out to ground floor to 30 people!!! (Hotel workers on contract). This made the already sad state of the building even worse.

        Now I have finally found a better place which is in the same layout and informed him on February 20th 2025 that I am moving out on March 10th.

        I cleared out the old place before the said date and moved into my new place. Now whenever I call asking for the deposit, his tone has completely changed and he is saying he is out of station and it can only be done once he is back.

        As per rental agreement, I had paid 1L deposit and 17.5k rent in advance. The agreement also states I have to give him 30 days notice and 17.5k will be deducted as โ€œpainting chargesโ€.

        Now , Iโ€™m supposed to get back 82,500 (1,00,000 – 17,500). But going by his tone and his disinterest I am really worried about my money. I have taken care of the place really well and infact have left behind a couch and all the window blinds I have got there.

        How can I ensure I get the rest of the deposit back?

        Ps. I have not handed over the key yet as Iโ€™m yet to get my money. He had asked me to handover the key to one of the neighbours.

        TLDR: Owner hesitant to give back deposit.

          Change the lock, keep the key with you, get your couch and blinds out of there and play the waiting game.

            Serve him a legal notice asap.

            In my experience as a lawyer he will keep delaying the process unless you indicate that you are more than eager to stake your claim.

            Most landlords fall in line as soon as a demand notice is served upon them.
