I am a NRI hindu from India. I want to know if my wife becomes beneficiary of my parent’s self acquired property in India if we divorce?

No. Only if they leave it to you in the will after they are not there and then if you divorce, yes. Else, NO.

Still no. Combined ownership of marital assets isn’t a thing in India.

Hi, thanks for your comment and the help! I needed some clarification on your comment. From your comment looks like if my parents have a will and me as a beneficiary in that case after the divorce my wife doesn’t have the right on the property inheritance but if there is no will being created by my parents in that case she is also the beneficiary? Is that correct ?

In the event of their death, it divulges to you and your siblings. There are many classes of heirs. It’ll come to your wife only after you inherit your share.

Does that mean if there is no will with me as a beneficiary then she will have a right on the property inheritance from my parents but if there is a will with me as a beneficiary then she has no right to the property inheritance from my parents?

She will never have rights into your parents self acquired property. But if they have passed away and property is in your name now then it’s considered your networth.

She can claim maintenance and/or alimony based on your networth and lifestyle at the time of divorce.

The wife does not even have a claim on the property you currently own (the title is yours, not co-owned), let alone the property you might inherit from your parents in the future.

What your wife is entitled to on divorce is maintenance and not a share in your property. In case of divorce you will be expected to provide enough to let your wife continue with her life as it is… for example if her normal monthly expense was 10k rs you would need to give 10k.. but if you are super rich and normally she buys clothes worth lakhs of rupees then on divorce you would be required to give maintenance based on that standard i.e. allowing her to continue with same lifestyle..

What if I’ve bought a property before and after marriage along with my mother? Will my spouse be able to claim it after divorce in alimony if she has made 0contribution towards it?
