        I have a relative who is facing domestic abuse from her husband. She is also been intimidated by him that if she files a complaint he will ruin the future of her kids (1 girl in college and 1 boy in school) by not paying for their studies. He is also having multiple affairs and whenever she speaks up about that she is brutally beaten.

        I adviced her to follow legal route but she is hesitant due to her kids and thinking that her husband would have a change of heart. After a recent incident her daughter has reached out to me if I can connect them to someone who can provide legal advice. I am trying to ask around in the people I know. I don’t want to give them a advice that would prove harmful hence I am here.

        How can I help them? Any contacts or people I can connect them with?

            Buddy, seek a good lawyer. Your relative has no cause of apprehension of the kids’ future, as they have the right to their father’s property & maintenance. At the same time, I would suggest that she can seek employment or new initiatives to secure her children’s future. I know saying it is easy & reality is often emotionally roller-coster, but it is the path that has to be treaded.

                I think her fear is that these things take time and how would she survive during those times? her kids education and other things.

                  Indian justice system is very favorable towards women she should not fear for any legal action

                    1. She can file a Domestic Violence case either through the Police or directly in the Court.

                    3. She can seek maintenance. The case may take long time to settle. Meanwhile Interlocutory Applications can be filed asking for Interim Orders on Maintenance during the pendency of the case (Alimony pendente lite).

                    4. If she isn’t willing to go for the case immediately, whenever she is beaten up physically, let her go to a hospital for treatment and register it as a Medico Legal Case (MLC). Few such incidents would prompt police to call him and advice him. This could be the starting step to gather courage.

                    5. She can seek maintenance even if Domestic Violence Case or Divorce case is filed. If she wants to move away without filing any complaint, she can do so. But she has to gather some evidence of his violent behaviour. Otherwise husband will claim that she is the one who walked away.
