May 6, 2026 at 6:33 pmI’m dealing with a drink & drive case under the Motor Vehicles Act in Maharashtra and I’m looking for some clarity from people who understand legal procedure.Today was my court date (JMFC level). I went without a lawyer because I didn’t know the process. I apologized to the judge and said I was ready to pay the fine.
The judge responded strictly and mentioned punishment like fine + up to 6 months jail. I again apologized and mentioned my responsibilities. After that, the judge told me to come with a lawyer and ordered me to appear in court once every month for 6 months.
I have also received a bailable warrant (₹2,000 bond) earlier to ensure appearance.
Now I’m confused about a few things:
Is this monthly appearance order normal in drink & drive cases?
Does this mean jail is still a possibility, or is this more of a lenient/monitoring approach?
Can a lawyer help reduce the number of court visits or close the case earlier with a fine?
What is the usual outcome in such situations for a first-time offence (no accident involved)?
Is there anything specific I should do before the next hearing?
Any guidance from lawyers or people who have handled similar cases would really help. Thanks.

May 6, 2026 at 7:30 pmhighly unlikely. You’d have to royally mess up to get jail time here.just do what the court says. stay in their good graces.

May 6, 2026 at 7:57 pmRemember! The lawyer’s fee will include something for the higher authority. Reason why you have to appear in the courtroom with a lawyer.

May 7, 2026 at 1:09 amFrom what I gather, judges takes offence for appearing without a lawyer. They have a system and they’ll protect it. Take a lawyer with you. It may be a simple procedure, but still take one. Don’t be Pennywise, pound foolish. Don’t think that it’s a simple procedure, why to spend on a lawyer if I am going to pay the fine anyways. Lawyer fees and other chargers are hidden chargers of our system. -

May 7, 2026 at 5:50 amMonthly appearance is usually to ensure you attend court and do not automatically mean jail is certain. For a first-time drink & drive case without an accident, courts often lean towards fines or a lighter outcome, though punishment under the Motor Vehicles Act is still possible. talk to a lawyer before the next hearing, as they can seek exemption from repeated appearance and help close the matter properly. -

May 7, 2026 at 6:03 amYou are lucky to get off lightly. On a bad day, Judges often make an example of some cases. This Judge gave u opportunity. Get a lawyer. Attend court once every month. Unless u appear in court drunk and drive your car inside courtroom, it is highly unlikely now that Judge will send u to Jail else he would have already done that. Dont try to push him by asking to remove the Monthly court visit or reduce it.
