        I need to know what charges can be pressed against my dad who is harrassing my mom since I was born.

        Almost every other day mom gets beaten up by dad and so do I when I try to help her.

        He brings up dowry in every fight .

        Has affairs sometimes with other women.

        Also mom has no support system, she isn’t that much literate and has no income system.

        He has threatened to kill mom many times. She’s sick constantly and is wasting away.

        I am currently studying so no income from my side as well.

        My question is if mom presses charges and asks for divorce will mom be able to get alimony and one of dad’s house?

        Please help me also this is my first time posting here. Eng isn’t that good please give genuine advice .

        I want mom to be divorced.

        For proof I just have audio recordings of dad’s problematic behaviour.
        He restricts everything for mom. Eating , laughing , visiting her sisters.

        I would like to mention no one from mom’s family can be of much help we’re pretty cornered.

                    Hi there, I understand your situation and what you and your mom are going through.
                    the only valid ground for divorce in your case would be cruelty.
                    Yes it is possible to get alimony for your mom to maintain her daily life.
                    Other than that simultaneous case for dowry can be filed.
                    If you are a female then you can also get maintenance till your marriage.
                    Other than that, you should contact a divorce specialist in your district court.
                    If you are residing in Delhi, I would be happy to assist you in person.

                        I am not from Delhi thanks for helping this is what I wanted to know will things legally be in my mom’s favor

                        Thanks for telling me also please tell me will mom be homeless dad has two plots will mom get one to reside in?

                            If those plots are not ancestral property and self earned by your dad and registered in his name, then only you can claim them.

                                Yes it’s in his name and not a generational property he always threatens that with divorce mom will be on footpath this is the only fear stopping us from taking legal action.

                                    See, when the legal proceedings would be conducting, you and your mom should live separately from your dad and it will take time to get favourable order from court. So for that time you have to live somewhere else, maybe at your maternal relatives home. After which some remedy shall be granted by the court including maintenance or allowance and compensation or the plots.
                                    Just remember every claim by your side in the court should be proved by your lawyer. Any negligible fact would result in unfavorable order.

                                        I am sorry I am bothering you a lot but how can we pay for a lawyer when we don’t have access to funds . Can lawyer be paid after the case is finished?

                                            You can ask for free legal aid lawyers from the respective bar association in your particular district court. But I wouldn’t suggest them as they aren’t highly skilled and they won’t take matters seriously. Still if you can manage any financial help, it will be great.
