        I was employed as a teacher at a school in Kerala, living on the same campus as the school in their hostel. I joined in November 2024 and submitted my resignation on January 31st, 2025.

        After resigning, the HR informed me that I would need to pay three months’ salary as per the contract. However, I cited that I was still on probation and should not be liable for the payment. The exact duration of my probation was never made clear to me, and they seemed to use this as a means of blackmailing me.

        I had requested an early release on March 22nd instead of March 31st, as I had exams back in Mumbai and there was a PTM scheduled on March 29th. I received verbal approval from the principal and the headmistress for my early release on March 6th. However, on March 15th, HR began to act difficult and backtracked on the approval.

        There were many in person meetings following that with the hr, headmistress and principal. To document the events, I sent a formal email on March 21st detailing the situation, which enraged the administration. On March 22nd, I completed the handover process, but HR claimed that they had not received clearance from the principal and the principal and and hr were not in the campus and refused to release my Master’s degree.

        When I attempted to leave with my luggage, I was halted at the school gates by security citing a lack of clearance from HR. This situation was extremely mentally exhausting and left me feeling trapped.

        On Monday, March 25th, the school revoked access to my work email without prior notice. I had been using that email to follow up on the handover and formalities. Fortunately, I had taken screenshots of the emails I sent and received before losing access.

        Currently, they are withholding my degree and may withhold my salary as well. I’m seeking advice on whether I can take legal action against them for:
        1. Withholding my academic documents.
        2. Blocking my email access without notice.
        3. Potentially withholding my salary.

        I’m concerned that pursuing legal action might impact my future prospects, as the school’s management is highly influential and powerful in the region.

        What are my legal options? How should I proceed without jeopardizing my career?

          Send them legal notice, they can not hold your original documents, even keeping them is illegal, seek damages, they will pay. Find a good advocate.

              Even i was thinking the same. I’m planning to approach the DOE office first before sending a legal notice. I hope they get rid of their toxic HR practices.

                  If you want minimum trouble, there is a normal way also, write a simple mail and ask them to treat that as legal notice, add all your demands and relevant laws, then send the mail, if they are smart enough they will clear your dues and return all documents.
