April 12, 2025 at 3:32 pmTL DR : After the owner was involved in a minor accident, their electric vehicle was dropped off for service. The following day, the EV unexpectedly caught fire and was completely destroyed.I met with a small accident at night one day , I was driving back home and it was raining heavily, Some construction work was going on and there were no hazard warning. There was a big pit filled with water right on the curb of the road. My vehicle fell into it. Being an EV it was not starting as expected and we dropped it off at the service centre next day.
But on the same day night vehicle caught on fire ( reason given by the service centre – battery damage) , it was totaled and I am left with no vehicle now.
First two months they were very cooperative and supportive ( verbally offered me any car from the brand for just a very minimal cost) but now they are not keeping their word and not helping me claim my insurance as well. Also they are not giving evidence or any report of the incident.
What can be done legally if something like happens ?

April 12, 2025 at 3:54 pmHave you filed a FIR ? Have you initiated the insurance claim ? It is possible the insurance company will claim there was a manufacturing defect in the car/battery that caused the fire and try to pass off liability to the manufacturer.-

April 12, 2025 at 11:43 pmYou have to be proactive. File a report with the police. Escalate with both the car company and the insurer. Reach out to social media influencers to publicize the matter if you have to. Neither the manufacturer nor the insurance company has any incentive to take the matter forward. If you don’t take strong action , they will just keep kicking the can down the road. The car caught fire when it was under the custody of the service centre. Ask them for a written report to share with the police and insurer and escalate to the car company ( not the dealer) if the dealer is not helping.

April 14, 2025 at 12:35 amNot sure what is age of your vehicle and your insurance terms and conditions.But their is no deal negotiation in insurance insurance is for accidents and this is an accident you will get money as written in insurance terms.
Now comes compensation from showroom go to them just ask a simple thing WILL YOU PAY?
If they say yes then discuss the amount if they don’t just simple go to a lawyer it will take time but majority of cases if vehicle is total loss people gets around 80% from the service center as this way neglect from their part.
Don’t delay it further

Collect cctv evidence from dealership via lawyer.

April 15, 2025 at 7:22 amAdvice: Please write dates instead of this, as Saturday, Sunday comes every 7 days. Also the accident happened 7-8 months ago and you still haven’t approached a lawyer is ridiculous. Kindly approach a lawyer at the earliest.

April 14, 2025 at 12:40 amDo you have the CCTV footage access from the SC?You can also send a notice to the SC asking for your car back or giving a written explanation of what has happened. Theyβll quickly fall in line.
I donβt think you should be using your insurance because it isnβt your fault. Once you have all the evidence, file a consumer forum complaint against the SC and OEM.
