Evidence of sleeping or staying at a place

My husband and I were staying together along with our child. I was trying to separate amicably so I took up a place in a nearby apartment. While I was not staying at the place, on and off I used to sleep at the new place. In about 15 days after my taking up the place, my husband has fled and taken our child away and he’s claiming that I have deserted and abandoned my child and him as I had moved into the new place. How do I prove that despite taking the new place I was actually staying at the common place. Does sleeping in a different house tantamount to desertion?

Hi. I’m a lawyer here. Merely getting a new place and sleeping there intermittently does not amount desertion, for sure.
