        This is happening with a friend and her father is of no help. The relationship went on for 6 months and they talked about a possible marriage. In the 6 month relationship, he wasn’t supportive, didn’t have a stable job, and didn’t treat her the way she wanted (she asked to be given flowers on 3 different occasions, even just a 5 rupee rose, or out on a proper date). She comes from an economically difficult family where she takes care of her parents, pays for most of the things in the house including rent. She also took on two jobs. She paid for dates and bought him multiple gifts. He hails from a well to do family and is 31M. Her being 29F she didn’t see him step up as a potential partner and ended the relationship when he ghosted her a second time without any information getting angry for a picture with a male friend. She kept calling him to clear the misunderstanding and he refused to pick up. After all this, when she broke up with him and deleted him from her followers, he got might I say, psychopathic. Kept calling her and threatening her to the point where he talked about ruining her image and her life and never letting go and so much more. She lodged a complaint but the police sent him off with a warning and a signed letter. After more than a month she recieves this legal notice. She has proof of all the messages he sent her, even a recording ofa phone call detailing the relationship. What should we do next? He clearly wants to draw this out to hurt her financially and to let her father i as he is abusive. Please help.

          To prove defamation, a plaintiff must show:

          The statement was false: The statement must be false, as truth is a defense to defamation.

          The statement was published: The statement must be communicated to a third person.

          The defendant is at fault: The defendant must be at fault for the defamation, at least to the level of negligence.

          The statement was unprivileged: The statement must not be privileged, meaning it is not protected by law.

          The statement caused damages: The statement must have caused some harm to the reputation of the person or entity being defamed.

          If what your friend is saying is true and if she is innocent with all documentary proof. She need not worry.

          If she gets a summons from court she will need to hire a counsel but I don’t expect things to go that far.

              With the defamation, she hasn’t posted anything or said anything about him to anyone. Except of course talking about what’s going on in the relationship and asking us friends for help. Right now it’s just a legal consultant who has sent the letter through a registered post, a pdf through WhatsApp and email. She is worried about the monetary toll it might have on her which he has mentioned in the past he would exploit. Should we be taking a step or wait to see what happens?

                  I am not clear about the monetary toll bit. Can you explain this?

                  Also, if she is from a weak economic background and has paid for most things then where is the exploitation..

                      She is like you said, with a weak economical background. And yes, she paid for most of the things too. But he is still claiming it as her asking him for expensive gifts, high end dates and travels. Which she never received. She did ask him to take her on a proper date to a restaurant and possibly not a meal on a plate sort of place by the road.

                          You and your friend need to relax.

                          You can simply ignore this letter for now. No compulsion to respond. You could if you want to end the matter.

                          There isn’t any merit in his case.

                          If I were you i would wait for now and if there is another notice I would respond to it through a lawyer.

                      See simple tell him that legally there is lot of things that can be done tell an elder to tell him this thing tell him to stop this nonsense I guess he will stop once you telling this

                          We took him to the police and got a letter written and signed since what he was doing was under stalking and harassment. He wrote that he won’t contact her or her family further on. Elders were of no help which is why we approached the police. It’s written in the legal notice that he was “coerced into writing the letter in order for the complaint withdrawn”.

                          Get an FIR of molestation and harassment registered against the guy. That will sort out all the issues.

                                  Yes, we don’t want to file false charges. We just want the man to leave her alone without causing more issues with daily life. We did approach the police a month or so ago for Stalking and Harassment but didn’t file an FIR and sent him back with the letter that said he will stop contacting her and made him delete all messages, photos and her contact info.

                                Lawyer here. You could either ignore or send a reply through an attorney, which would cost you a nominal sum. Either works and don’t fret too much over it. If any developments happen, lmk.

                                    She contacted a lawyer after much deliberation and he said he’ll be charging 10k for sending a notice. He has told her to come to him with all the proof in person and will state mental harassment as their stand. The money is a lot for her but will request him to lower the costs a bit? The ex’s intention is clearly for her to spend money. Thank you for the information and reply to the post. I’ll keep you informed.

                                        10k is an overkill to charge from someone who’s already under such distress. You could def get it done at a fraction of that price.

                                            Seems like ignoring the legal notice would be the best course of action here. It’ll save money and since she has all the proof, she can later move ahead with a lawyer if things go south.

                                            Just tell her to keep multiple backups of all the chats, recordings and proofs in cloud storages and physical storages.

                                                We thought about doing that, but the input is so split about sending a reply or ignoring it. We thought we’ll just pick an advocate to ask for a course of action by having them take a look at the legal notice and the proof we have. She has actively made back ups too for the same for whatever is available. She had deleted his pictures and messages at the police station because he had threatened her that she shouldn’t dare to block him otherwise “she will regret it”.

                                                    Very poor decision to delete proof. He’ll regret if things come out.

                                                    Try to get back whatever she has deleted by using some data recovery software which she can download. If she didn’t delete it long ago, she’ll be able to recover much data.
