So I am working in a MNC where I used to work with a colleague. One day he tried to assault and threaten me out of now where. So naturally I made a complaint against him in the company. Now after that a investigation in the company began and went on for 6 months and he was fired after that. It’s been more than 1.5 years and called me from an unknown number today that he will complain against me in the police and file an FIR against me and my other colleagues stating that I was conspiring against him as he was a local. He also said after the FIR I will lose my job and won’t get a new job anywhere. He is also using a threating language and asked if I live at the same place so he can send people after me. He is hell bent on taking revenge on me swears to destroy my life as he thinks I have destroyed his. What action should I take here and can he really file an FIR against me with no evidence ?

Try to record the conversation, if he calls again. Also, please report to the police, as a pre-emptive action.

During the investigation, he complained to the police against me and the police threatened to file an FIR if I don’t take back the complaint from the company. The police also took 50k bribe from me to close the complaint.

Brother/Sister you have more than enough to go file a police complaint yourself.

                  Highly reccomend doing that.

He has threatened you with ohysical violence, with abusive words, and is also threatening with fake police cases – what are you waiting for ?

In an ideal world this wouldn’t have been an issue but practically yes he can file a police complaint or FIR against you.

The issue I couldn’t record his call so I don’t have any evidence of his behaviour, but I will visit the police station and file an complaint

Ask a lawyer if you should take back complaint

                      Or file another

I have filed a complaint with the police but I can’t inform the company because they will see it as a nuisance and will find ways to punish me. When I informed the company about the police complaint by that other person during the investigation they told me straight they can’t help and rather I should not inform the police about any details of the internal investigation.

He’s lying, what he’s saying will be a complaint, not FIR without any evidence. Even if he manages to do that, it has to be against the company, not you. And even if he manages to do that against you, police won’t do anything to you, you can just ask them to send a legal notice.

File a complaint for harassment & threat to assault. Inform your company about this incident. He’ll call you, record it next time there’s tons of apps. If you have enough to register the FIR then you’re safer but I don’t think that would happen at this point.

This should be enough for now. He has no grounds to do anything to you at this point. But he can assault you so better keep things moving at your end for immediate reaction.

Thanks man for the information, but informing the company will be more problematic for me rather than a help. And what I have heard is that he had already filed a case against the company and the case is ongoing. The decision might have come against him so he wants to avenge me. I have already filed a complaint against him with the police now and about the bribe it’s been 1.5+ years and there is no evidence that I paid the police, I paid the bribe to the lawyer through UPI which I had hired who duped me after talking to the police as he was a local too. I don’t know how much he paid to the police and how much he kept with himself.

Well, you can still mention it in the letter. The idea is to pressurise them to act, not get them out of their jobs. The allegation alone will trigger investigations for any sort of bribes, that will make them work harder for you asking you to withdraw the complaint.

Anyway – informing the company won’t be problematic. It makes them liable. If they find it out from a separate source, they can let you go under other reasons “performance etc”. But if you send an official email to them and then they try to remove you, they’re liable & can hold them accountable.

File a report . Just to be on safe side. Also file a written complaint with your company HR mentioning what has happened .

Talk to your HR. Tell them the situation. He can do sh*t as your co has investigated and with proof he was thrown out.
