UHello everyone,
I’m writing this post with a heavy heart, hoping to get some advice on what I can do next.
I’m working as a Graduate Engineer Trainee in the Quality Control Department at a private company. Since January, I’ve been facing harassment and retaliation from a senior manager, and it’s affecting my mental health badly.
It started with small inappropriate gestures, but recently things crossed the line.
Harassment Incidents:
He held my arm tightly in front of another employee during work.
Another time, he grabbed my arm and waist in front of a senior colleague. I felt so uncomfortable, but I froze at that moment. I remember crying so hard after releasing what actually happened to me.
After that incident, I gathered the courage to confront him and reported everything to HR. But instead of taking action, things only got worse.
Retaliation Tactics:
He tried to change my shift timing to morning without any reason — I refused.
He then tried to relocate my workstation near his office — I refused again.
After that, he transferred me to another office location, away from my team and my work.
He removed me from the official WhatsApp group without any explanation and started spreading rumors that I had been removed from the company to show his power.
Even after informing HR and senior officials multiple times, no action has been taken. I also tried reaching out to higher management, but no one responded appropriately till now.
What hurts the most is that the company’s owner had personally assigned me important tasks before an audit, but this manager kept ignoring those instructions just to harass me.
He has even made disrespectful comments about my family in front of others.
I’m trying my best to stay strong, but mentally it’s breaking me every single day. I’m constantly scared to go to work, and I feel like no one is listening to me.
I Need Help On:
1. What legal actions can I take?
2. Should I file a complaint with the Labour Commissioner or Police?
3. How can I escalate this to higher authorities outside the company?
4. As a trainee, what are my legal rights in this situation?
I’m mentally exhausted, and I don’t know where else to go. Any advice or guidance would mean a lot to me right now.

UI complained to the higher authorities of the company like the HR, CEO and Directors.They all are asking me to wait for few more days for another authority to comeback from trips who will be incharge of my issues. Shall I wait for now for the authority to take actions or file the FIR ?
Also I asked for the contacts of POSH internal committee members but the HR denied saying that we don’t have any such committee in the company.-
Bdon’t wait. Simply File FIR in nearest police station for molestation. Posh in small companies is useless and exist only on paper.

BThe a friend with you while going to police station.
exaggerate story to cops and insist on FIR
complaint is useless. Tell them he tried to kiss you.
Because for mere holding your back, cops might downplay incident and indirectly refuse to file FIR.You can take lawyer with you if it’s bangalore take st_broseph along with you

UI don’t have such a courageous friend or family to take along into the Police station.
Although I have a cousin who lives nearby and she is pursing LLB but I doubt she will join.
What are your suggestion after this ?-
BIf it’s Mumbai, you can go alone and cop will register FIR.
If it’s Delhi /NCR . You will have tough time. They are known for not taking FIR so better to take someone with you.

HAlways make all complaints etc. in email or in writing. Never rely on oral complaints as they will deny you ever made any oral complaints. Also, try to get some evidence to back up your case. I doubt any employees will make any statements as they might be afraid of retaliation.
If your organisation has more than 10 employees then it is required to constitute a POSH internal committee. If they have not constituted a POSH Internal Committee then they are already in the wrong. But it most likely is that the HR simply lied to you because they don’t want a mess.
In any event, If there is no POSH internal committee then you can file your Complaint with the Local Committee. Every district has one.
Apart from this, you can also directly file FIR against the person for sexual harassment.
