February 14, 2025 at 12:04 pm**Background:**One of my friend was in a relationship with a girl for almost two or three years. They were physically involved (consensual). Later, despite both of their families unwillingness to marry each other both agreed to their marriage and held an **engagement ceremony** in the presence of relatives and friends. The girl’s family agreed that my friend (who is working in **Dubai**) would marry her after returning in **two years** due to his job contract.
However, **after 5-6 months**, the girl’s family started pressuring my friend and his family to **immediately conduct the marriage**, despite knowing that he couldn’t return before completing his contract. After a month of discussion, the girl’s family **canceled the engagement** and returned all gifts.
**Strange Turn of Events:**
* Before filing the FIR, the girl repeatedly **called my friend’s parents**, **crying and begging for forgiveness**, requesting to reconcile.
* She was **desperate to reconcile**, but my friend and his family had already accepted the broken engagement.
* Soon after being denied, she suddenly **filed a false dowry harassment (Section 498A) case**, alleging that my friend’s family canceled the marriage due to **dowry demands**.
* The **police have now summoned my friend’s family** for questioning.**Current Concerns:**
* What could be the possible outcome of this case?
* What legal steps should my friend’s family take to protect themselves? -

February 14, 2025 at 12:42 pmAlways send a lawyer first or a relative who is not in fir, because you don’t know the officer’s intentions and he may end up arresting you or the family members. Keep that in mind.The police needs to send a official notice. Online communication like whatsapp or email not allowed now.

February 14, 2025 at 1:34 pmThe only thing here to do is to get a good lawyer. Ask your friend to do not delay and hire a reputed lawyer, Your friend could be convicted of false rape and the girl’s lawyer will definitely suggest this once the case move forward. -

February 14, 2025 at 1:38 pmSection 498A IPC is not applicable because it is filed by wife against her husband. Since they were not married, there is no question of Section 498A IPC. Just engage a good lawyer to help your friend out. -

February 14, 2025 at 5:33 pmTell him to lawyer up asap, let the lawyer accompany the family to the police station and be present in the questioning. If an FIR is lodged ur friend being an NRI maynot be able to leave India till the matter is dismissed or worst he can be arrested on arrival as this is a criminal offence. By the way 498 a will be a different section now under BNS as IPC is repealed. -

February 15, 2025 at 5:28 amThrough a lawyer find out what case has been filed. It could be under Dowry Prohibition Act, where demanding dowry is also punishable. Read further [https://divorcebylaw.com/dowry/](https://divorcebylaw.com/dowry/)Only once you know what has been filed, you can make the next move to get anticipatory bail, if there is any FIR registered under provisions of law which warrants arrest.
If there is no FIR registered yet, your friend/ family can talk to the complainant in the presence of police and can close the matter, it will save a lot of trouble.
