        My friends bank account was involved in a cybercrime. He had opened an online idfc bank account in 2023 after clicking on an referral link. After a few months there was a credit and debit of rs 0.77 crores. He got to know about it later when he checked the account statement one random day later because he did not receive any notifications. He emailed the bank letting them know of this but didnโ€™t receive a reply. He further took no action and forgot about it.

        This month he received a letter from Bangalore cyber police (CEN PS) saying he has to appear before them in 3 days. Apparently some old lady in Bangalore had got scammed by a gang and the amount was transferred via my friends account. She lodged an FIR and he was falsely implicated.

        So my question is what should he do next? He has already arrived in Bangalore. He is poor.
        1) Should he get a lawyer before going to the police?
        2) Where can he get a good lawyer in Bangalore?
        3) If no lawyer, what should he tell the police?
        4) If any other information he should know.

        Please help!!!

                How though?

                It’d be better if you could explain so we can learn. I know it’s possible when you’re doing crypto P2P but without anything, how can payment (that too of 80L rupees) come and go from your account like that

                    His friend knows everything.. howmuch percentage his friend got or his phone must be hacked .. if money transfered from his bank account online then verify his phone.. if money trasnfered through cheque then ask his friend

                        Yea but OP said his friend realized after months whilst checking the statement. How’s that even possible? A big deposit like that and then immediately debited as well.

                                Yes get a lawyer before going to the police and file for an anticipatory bail before the High court of Karnataka and say that you’ve been falsely implicated and that you shall surrender before the police and comply with any investigation procedure , and to grant immediate bail in case of arrest what’s said above will be automatically be done by the lawyer anyway, don’t waste time do this fast. I’m a lawyer and we’ve done similar cases before

                                    Got it sir. And he can get lawyers from Bangalore high court? How much will they charge?

                                      In the letter it is mentioned that โ€œ If you do not attend the enquiry, further legal action will be taken
                                      against you, due to your non-appearance.โ€
                                      So, anticipatory bail plea is applicable for this enquiry too?

                                          Yes. And I can’t really say how much they’ll charge. Better to spend a few thousands now than go to jail unnecessarily, it’s possible that the enquiry is a typical one where the cops know that you’re as much of a victim as the lady who lost her money. But it’s always better to be safe than sorry. With an order from the High court in hand the enquiry and questioning will be a much more easier and comfortable affair

                                        Move to City Civil and Sessions Court for anticipatory bail under section 482 of BNSS,2023 and also move an application to defreeze your account if it is freezed. Better contact a local lawyer.

                                                There are good lawyers, but in order to get poor lawyer he should be poor otherwise you have to get your lawyer on your own

                                                    You have to attend inquiry only, they cannot arrest you when you get anticipatory bail.
