        I have a civil case pending in the HC of Karnataka and it is in the FINAL HEARING stage. The last hearing was in the month of June 2023 and since then proceedings have been adjourned.

        I wanted to know how does this hearing work and when will my case be called out again for further proceedings?

        The case is a regular first appeal, against a decree passed by district sessions court. RFA was filed in the year 2017 by the judgment debtor appellant. I am the decree holder respondent

              Although I consider myself very lucky to get a decree in my favour itโ€™s not the answer I am looking for ๐Ÿ™‚

                  Itโ€™s a legit answer. You can move an application for an early hearing and quick disposal but it wonโ€™t be helpful in regular course. And this is not the only appeal you might have to contest. So hang in there!

                          Without any legitimate urgency, the applications will get dismissed. And civil suits rarely have any urgency unless a stay is needed.

                          What you can do is get your lawyer to press the court to fix it for final arguments and make it the last opportunity for both parties to argue, failing which the case shall be dismissed (if itโ€™s the appellant thatโ€™s delaying the matter)

                              So does my lawyer approach the registrar to fix it for final arguments and registrar assigns the case to the judge ?

                                  No. Your lawyer just does it by making a mention/request on the day it is listed next

                        You can track your case in the HC website and also login as a mute audience to see what is happening in your case live. It has been really long time that it is getting adjourned. The dates are given on the previous working day late evenings. The cause list will be put up in the website. You can check the cause list, court hall wise. If you know the case number and court hall number check every evening at around 8 pm or later to se if it is listed. If it is not being listed for a long time, your counsel can raise this concern with the Registrar.

                            Hi thanks for your response. Is there anyway to check if any particular judge is being assigned only specifically to hear RFA matters? I am sure registrar and judges distribute case matters amongst themselves according to their expertise

                                The Court hall where it is assigned will be under a particular judge or judges (if it’s a division bench). The same judge would hear the matter, it changes only when there is transfer of judges or sometimes if the matter is transferred from one court to another for any technical reason.
