April 24, 2025 at 3:40 pmIn **January 2025**, I purchased a **Redmi 7A (2GB/32GB)** phone from **Flipkart**, advertised as **brand new with 2 years of warranty**. I bought it for my father, so I didn’t check much initially. A couple of weeks ago, I updated the software, and the phone went into a **boot loop**. I took it to a **Xiaomi service center**, and that’s when the nightmare started.They told me the phone was **already activated in 2020**, and its **warranty expired in August 2021**. They refused to repair it under warranty and claimed, based on their records, that this is a **refurbished Chinese variant** (not for India). I asked for something in writing, and while they didn’t state outright warranty denial, they gave me a **job sheet** that clearly shows the expired warranty date.
I then contacted Flipkart, submitted the job sheet, and explained the situation. They registered my complaint but kept extending the resolution deadline — it was supposed to be resolved by April 24th, and now it’s extended again to April 25th. Their internal team called once and said, “The brand didn’t confirm denial,” to which I pointed out that the **warranty expiry date is evidence enough**.
Also, I verified the IMEI number on Xiaomi’s own coverage site, and it confirms the device is a **Chinese variant** — another red flag proving it’s not meant for the Indian market.
One complication: since January, the phone has developed **cracks and scratches** due to regular use. I understand this may affect the situation, but my core issue is that **Flipkart sold me an old-used-refurbished phone under the label of ‘new’**.
# I Need Help With:
1. **Can I take Flipkart to consumer court for this?** Even if the phone is now damaged?
2. **Will I need a lawyer or spend a lot of money to do that?**
3. **Do I need to follow all proceedings physically?**
4. Is it enough to use the **Xiaomi job sheet and IMEI check screenshots** as evidence?
5. What should I do if Flipkart doesn’t respond tomorrow as promised? -

April 24, 2025 at 3:47 pmDamn bro i once received a used bluetooth headset from flipkart official seller too, these guys are playing this game since some time sorry for youNothing you can do i also did the same as you they keep on extending the date & after two months without any notification they closed the issue ( they used to close the ticket I again call & complaint) this continued for two months & i gave up the headset still working though

April 24, 2025 at 3:54 pmHi, I’m a Delhi based lawyer. Wow, Flipkart is stopping at nothing. Yes you can go to a consumer court even now. You can do without a lawyer if you must go to a consumer court but try that you have your pleadings drafted really well. You don’t need to follow all proceedings physically if you have a lawyer or the court has a provision for VC. In all likelihood, Flipkart won’t help much, so be prepared to sue them. -

April 24, 2025 at 6:33 pmI would put this out in social media with all relevant proofs and post this in all apps like quora, fb , reddit, whatsapp etc.. to alert others from falling for such Scams.Doing it anonymously is better option.

April 24, 2025 at 7:40 pmDefinitely you can sue them! Consumer dispute will cost you around 1 L to fight through a lawyer but that would be covered in your compensation. -

April 25, 2025 at 2:53 amAs some have pointed out, this phone was launched in 2019 and was discontinued a few years ago. Expecting a brand new device in 2025 is completely illogical.However, if Flipkart or the seller did sell the device claiming it’s brand new, you can file a case. You also need to verify the seller. Flipkart, in addition to selling on its own and subsidiaries, provides a platform for so many sellers throughout the country. If it’s not a “Flipkart assured” seller, you have to deal directly with the seller.
In India, the legal process is tedious and exhausting. If you have the time and money and also can make the effort, go for it. In this particular scenario, I personally feel it’s not worth it.

April 25, 2025 at 8:48 amyou ordered a phone which was discontinued at least 5 year ago from an non assured seller. i I am certain you wanted to save money got the phone for very low price and thought flipkart don’t know actually what price it should be selling.you should keep it in your mind not to order from non authorized seller.

Similarly, I only found out about it when I went to claim the warranty for my device from the OEM. -

April 25, 2025 at 5:55 pmOrder a new phone of around same price with COD. Take the phone and don’t pay the delivery guy. Hand a note to the delivery guy that you are keeping it as exchange for the scam done by Flipkart, you are ok to return it the day your original complaint is resolved by Flipkart and that the delivery guy is not at fault. Also call the customer care of Flipkart and inform them about the same.-
