Recently, my friend applied for a **home loan top-up** and was **shocked to find out he was denied** because his credit score had dropped due to a **loan default in a legal dispute** under his name.

        # Background

        * He is a well-established businessman with 15+ years in business.
        * He had **only ever taken a single home loan** 6-7 years ago, and his credit score was excellent then.
        * Upon investigation, he found that the defaulted loan dates back to **2011**, when he was added as a **reference** (not a guarantor/co-borrower) for a friend’s loan application.

        # Fraudulent Inclusion as Co-Borrower

        * In the loan application, **his name, mobile number, and address were added under “Reference 1″**, and he didn’t provide any documents.
        * He checked the loan application and **his name appears to be scribbled in as a co-borrower**—a clear case of fraud or misrepresentation.
        * There are **photographs of the actual applicants and co-borrowers, and his picture is NOT there**. Neither is his signature anywhere.
        * He had **no credit history in 2011** (he started filing ITR in 2015), so he couldn’t have even qualified as a co-borrower for a loan back then.
        * He remembers getting calls from some loan department regarding the case, asking him to push his friend to clear the dues, but he was never involved beyond that.
        * Now, **he has been denied a home loan top-up** due to this fraudulent loan being marked as a default in his credit history.

        # TL;DR

Friend’s credit score is ruined due to a **fraudulent loan default** from 2011, where he was only a **reference**, but his name was illegally scribbled in as a co-borrower. No signature, no documents, no photo, yet he’s facing consequences. Now, he’s been **denied a top-up loan** due to this. What legal actions should he take to clear his name?

        # What Are His Legal Options?

Would appreciate any expert insights! 🙏

File a case of fraud against the borrower and the loan provider and seek deletion of co borrower status from the lender restoration of cibil score and compensation

There are special agencies that do this kind of work, raise disputes with the relevant parties (often these debts are sold to third parties, who sell it off further) and tackle it to get your CIBIL score up.
