        So this morning, I received 6–7 calls from an unknown number. Since I didn’t recognise it, I didn’t answer at first. But the calls kept coming, so eventually, I picked up.

        I asked the person who he was and why he was calling. He said that someone I used to know in college gave him my number while taking a loan, and now that person has defaulted. Apparently, all the other numbers he provided are now switched off. The caller told me to contact that person or get him on the phone.

        I haven’t spoken to this guy in six years. The last time we talked, we had a huge fight, and I never wanted to speak to him again. I told all this to the collection agent, but like most agents, he kept pushing. So I hung up. He kept calling, so I blocked that number.

        Then he called again from a different number and started abusing me. I responded and then blocked that number too. Now he’s even calling from international numbers — must have called around 200–300 times by now.

        I went to the Cyber Cell, and their advice was to block the numbers, remove the SIM for a few days, and take down my WhatsApp DP.

        I want to know: Is there any legal action I can take against this collection agent or the person who gave my number without my consent?

          As you have seen, the person can easily use VoIP services and spoofed numbers to call you, so the police are unlikely to be of much help in this situation.
          You need to identify who the person is. To do that, obtain the loan account number and the details of the lending partner from him. Then, reach out to the lending partner directly, both via phone and email.

          Be sure to include the nodal officer or grievance officer in your communication. You may also contact the Banking Ombudsman to ensure your complaint is taken seriously.

              As said, I did not take the loan and the person who took it is not in my contact. The collector agent is not even telling his name, let alone the loan details. he is aware of the fact that if I do not provide any details, I won’t be able to complain. Trucaller shows him a slice agent. But seems more like a regular collector.

                  I never said that you have taken the loan or that you have any liability. What I am saying is that “your friend” has given your name as a reference and then defaulted on the loan.
                  Now, this and any other TPA will get the file with the same details and will continue to call you.
                  They are not paid enough, nor do they care enough, to make any corrections to the file.

                  The only place where you can get any sort of correction done is at the source, the lending partner.

                          If he’s not providing any other details then honestly get a spare sim and take out that sim for a week or two. And wait out. Don’t lose your sleep over this. That guy can’t have your other details except the phone number so just take the number out of the equation. They’ll be forced to contact the original loan taker through his home address or whichever address they have provided.

                      Isnt it an criminal act in the first place for this agency to go through someone’s call history n start making random calls?

                      do telecom companies sell them this confidential call record data or is it they bribe some emplyees?

                          In this case, the defaulter “friend” has given OP’s number himself. But I understand what you are saying and no, the telecom companies do not share any data in this.
                          Mainly, it is the banks (mostly NBFCs) that, during the installation of their application, take access to your phone’s data(sometimes with consent, and sometimes without). They then use that data in such “recovery” efforts.

                          Under RBI guidelines, this is not allowed, and any lending partner engaging in this can be heavily penalised.

                        Don’t have any legal advice. But while you’re at home, office or whatever pace that has reliable internet connection, turn on airplane mode and call using WhatsApp.
                        Block all his known nos. on WA.
                        Update status settings to “My contacts” and let them know to call you using WhatsApp.

                        Alternatively you can: Open WhatsApp -> Settings -> Privacy -> Calls and select “Silence unknown callers”
                        Then setup voicemail on your phone telling to call you on WhatsApp.

                                  Use Truecaller and block all unknown numbers by default. Now you get calls only from numbers from your phone book.

                                Just lift the call, **mute it**, and stay silent. Don’t put on speaker as you don’t want to listen to what he is saying, you just want to drain his energy. The other person will say hello hello, will get fed up, and cut the call. I think he will never call you if you do this 4-5 times.

                                        I saw a video where they pick the call and put the phone under a metal jug and hit the jug with spoon. Tan tan tan..or vigorously move the spoon to create noise

                                      You can download and use Truecaller, it has the option to block identfied spam calls, international calls, call outside of contact list, etc. You select blocking options in settings.

                                            Find out who the lending partner is and file a harassment complaint with the RBI ombudsman. My brother had a similar situation years ago. Someone had apparently taken a credit card from ICICI bank in his name and had defaulted on payments. For around 6 months he’d get weekly calls for repayment. We tried to explain we had no account with them and it must be an error(which it later turned out to be). We filed an FIR in the end and filed a complaint with RBI. Never heard from them again.

                                                The fact that anyone borrowing can randomly throw around some phone number without due verification and money is disbursed based on such assurances just shows how messed up our country’s financial practices are. This is not the first instance of me reading such a post.

                                                          Something similar happened to me , a neighbour of mine used my number as guarantor while taking loan from slice cards, he called me again and again; even used a threatening tone ; so I literally abused the hell out of him. Unless you’ve signed as a guarantor on that loan either physically or digitally, you have no liability. He’s just harrassing you don’t worry, show guts

                                                                On the point you should have said no I didn’t study/different college etc and don’t know anyone like that. Then say that guy made the lenders chutiya by giving wrong number. Then even if that guy keeps calling you, go to your nearest (rather go to the Central) police station and file an report.
                                                                An officer will call that number and tell him to not harass you. Then if the lender still does chudur budur, then he will fuq up big time.
                                                                This is not an cyber crime police problem go handle, but an police station issue. (Go to Central police station)

                                                                    Listen to me, this happened to me sometime back.

                                                                    I got a call from someone stating if I know someone who was my colleague and a friend. When I asked who this is, she said I am from the finance department .

                                                                    To which I said yaa I know him, Is everything fine?

                                                                    Then she started asking for his number where I got confused how come the company doesn’t have employee details.

                                                                    I called the friend and asked about it to which he said man they are loan recovery agents that was some 15 years back and they randomly call and say I(my colleague) is liable to pay which legally he is not, so don’t bother and give my number If you want.

                                                                    She called again then I said he is not picking up and stopped calling me I can’t help.

                                                                    And all hell was let loose she changed the way of her talking and started being rude to me.

                                                                    Cutting story short, I blocked multiple numbers and she called me every hour literally even when I said I will complaint to police.

                                                                    Her reply, Call anybody and block as many numbers as you want.

                                                                    I almost got sad and stopped picking any unknown number.

                                                                    Some how when she called, I got really agitated and strated abusing from the bottom of my heart.

                                                                    Mainly on the lines that I am not his father who you are calling I cant do shit and call me as much as you want, I will pick every call from now and abuse you to let my day’s frustration out. And a lots of super bad slurs

                                                                    To my surprise she cut the call and the harassment stopped after a week.

                                                                    TL;DR – abuse as much as you want, and tell them to call so you can let your frustration out because it’s not your loan.

                                                                      You can try calling your ex-friend and figure out if it’s even true or not. It could just be some random scammer. Or ask someone to pretend as the ex-friend since they want you to contact him to get some info. In the meantime there’s a free and open source spam blocking app called Spam Blocker(Call & SMS). You can get it on git hub or F-droid. Haven’t used it personally yet but it has great reviews so far and apparently works against even spoofed numbers. Also turn on block unknown numbers in your default dailer.

                                                                        Bhai scam hai.
                                                                        They’ll later say that they will settle the loan for less and ask you to send money installment like 40k etc.
                                                                        I also received the same calls 6 months ago. Receive their call and leave on mute, let them talk, dont need to kisten to them, let them talk whatever they want. I did this for two days, at last call he gave gali galoch for 30 minutes, then no call after that.

                                                                          You’re under no obligation. Your phone number was taken from Social media as you have an open friend list. Close your friend list and if he calls again, just tell him that you tried calling but the person doesn’t pickup the call. Ask him to Stop calling you.

                                                                            I faced a similar situation and my approach may seem counterintuitive and unpalatable but it worked for me. My tenant took loan from some loan app and gave my number as reference without my consent and then defaulted on the said loan. The agents started abusing me from the very first call they made to me and then started threatening about sending goons to my flat (where tenant resided). At first I tried ignoring calls but they would call incessantly. So I changed my approach. For the next few days I made it a point to receive each and every call even while I was in office. And in every call for each abuse they hurled at me I hurled 10 back at them. These were some of my most creative abuses in Delhi style. I would go to the washroom in my office to take the call and abuse the agent (if he abused me first). Once he even called me from his personal number. I saved that number and would call him between 10:30 pm – midnight for multiple days and then abuse him. This went on for 10-15 days but then the calls stopped. I suggest you take this approach

                                                                                  Been facing with this for few days now. Got a call where the guy said my relative gave them my number — pretty sure that’s a lie. Looks like some shady app scraped my relative’s contacts.

                                                                                  They spammed WhatsApp calls, then regular calls (Truecaller and my network both flagged them as scam). Picked up once — they immediately started threatening and abusing me, so I just hung up.

                                                                                  My father also got calls from same numbers on same day same way.

                                                                                  Now they keep sending threats on WhatsApp, even saying they’ll show up at my office (I don’t even live in same city where my relative stay). Pretty sure they pulled my location from my phone number.

                                                                                  They’re asking me to talk to my relative — I did, and they said they repaid their loan, but I’m not 100% sure if everything is fully closed.

                                                                                  Not scammer/recovery agent threatened to harass/call my other family members.

                                                                                  Came here looking for ways to stop this harassment.

                                                                                      There is a simple way to manifest in an Android app; they can do that. If they have told you they are from RBL, then you can simply file a complaint with their nodal office. In my case, he was not giving me any details whatsoever.

                                                                                          Recovery agent did not tell me. But now my relative confessed that they have due pending on their RBL card. And for one of the calls, truecaller showed RBL recovery agent but I ignored and thought I was all scam.
