Got a cockroach in my Burrito bowl (Famous Brand). Can I take a legal action against this?

I ordered from a very reputable brand named California Burrito, and was served cockroach in my burrito bowl. It was ordered via Swiggy. Can I take any legal action against California Burrito/swiggy.

Swiggy don’t control the quality of the food. It’s the restaurant which is responsible for it. You need to make a complain in FSSAI

I love CB because of the quality of food, this is first time I’ve come across such a situation..

Also, you can raise a complaint with Swiggy and they’ll reach out to the restaurant via email.

you will only recieve a compensation if fssai decides to do a hygiene check and raid on that restaurant and if it turns out restaurant is actually unhygienic…. else it will be very hard to win the case because restaurant will sue you back claiming defamation on purpose

You can approach the consumer court against California Burrito for deficiency in services (you clearly didn’t order a cockroach in your food). They will most probably take a defence that their food was clean and Swiggy added the cockroach, etc etc. Have all photographic proofs such as the photo of the food, the contamination (cockroach) and don’t tranfer them or sell your phone. It’ll be needed for a sec. 65B affidavit/certificate (you can read about it on Google).

As far as Swiggy is concerned they haven’t done any deficiency in services or unfair trade practices under the consumer protection act, 2019 as their only job/service was to deliver the goods. Which they did.

In effect, sue california Burrito in your respective district consumer forum. Consumer courts are very pro consumer, mostly friendly and hassle-free, it’ll take some time but you’ll most likely get some compensation and of course the cost of your burrito back.

Make a viral post on X with proof pics. Tag every stake holder. Then mainstream media will cover it in news. Then file case at consumer court. NAL

This! Also know that filing a complaint on consumer forum website does not need lawyer.

Additionally you can complain about food hygiene issues in a restaurant to the Food Safety and Standards Authority of India (FSSAI) through their online portal, the Food Safety Connect app, or by contacting their helpline

Be vegetarian and then sue them for serving non-veg food and also inform Bajrang Dal. Soon California Bowl will become Calcutta Bowl and you will get good compensation.
