POn the month of September2024 I saw a Honda City 2011 model listed on Facebook which was posted by A dealer ( Gold Partner of Spinny )
On 17 September 2024 that was my holiday , i visited the dealer at there place ( 350km away from my hometown ) to inspect the car , after calling them and booking an appointment with them….. but somehow they failed to show me the car on that very day… as I stay about 350 km away from there workshop… I had to return to my hometown….
Later I didn’t got time to visit…After some day when I called them to know more about the car they said such things :
• No Rust on the car
• No Mechanical Work on the car
• The Car got inspected by Spinny
• The Car got genuine meter readings.I also saw spinny mark on the back windshield so I
didn’t suspect more… I consulted with my family and confirmed the car just because it was inspected by Spinny…On 8th October 2024
I took delivery of that car without inspecting properly ( THE REASON – the delivery time was 11 Am but I got delivery at 3:30 Pm they didn’t even show me the car before 3:30 Pm , and as it will take me 8 hours to travel to my hometown , I was in a hurry )And as on December 2024 when I had given the car for a general service ( Hardly I have driven 1500 Km ) the experts are saying :
• the car has full of rust in the inner panels and in the underbody
• the car’s chassis is damaged ( accidental )
• there is work in both suspension and in the engine
• and the most important thing is the car’s meter is tempered…. ( I am having proofs )The car has work of more than 1 lakh and till now I had spent more than 30k estra and I bought it at a price of 1.90 lakh which was still more than market price… I paid the extra amount for spinnys goodwill…
Since they sold the product in the name of Spinny,
And there was also a spinny mark on the car,
They are also officially verified partner of Spinny,Now when I called the dealer the dealer said that he will talk with the owner and call back… But the call didn’t came yet it’s been 3 months. … Neither they picked my call… Recently I called spinny too… But they are saying they cannot do anything I need to consult with dealer….
I am having each and every details/proofs , what action can be taken ? Please help …

ASorry to hear about your situation, but there is a reason the market for second hand cars is called a market for lemons. Caveat emptor !
The situation you described is far too common, unfortunately. These cars are sold on a as is where is basis. Unless there is a contract that specifically holds the dealer responsible for these problems, there is not too much you can do.

AIt depends on what you have in writing from them. What they have said verbally won’t hold unless you have a recording.
Is there any written warranty or commitment from the dealer/seller ?

Pon 17 sep I went with my mechanic for pdi but they failed to show me the car on that day even though I waited for more than 2.5 hrs hours … They said to wait more but it was not possible as I was having train for my hometown….
afterwards they said the car was inspected by spinny the reason I trusted them

but I guess you can use those call recordings to bombard spinny online and file some consumer court case.
once you have a good social media backing they will have to respond.
