January 21, 2025 at 12:47 pmIts gonna be a bit long. So yeah around 2 months back I made a post regarding how a person scammed me. I will give a quick description of the issue: I own a garment business. Last year in September I met a client in Mumbai and he purchased goods worth 80k and he gave me a PDC of 10 days from the date of purchase. Later his cheque got bounced and after a bunch of fake promises by him I decided to go legally.
So I contacted a lawyer and he first sent a notice to the registered GST address and the notice came back to us as his office was locked. Again we sent a notice to him for the second time and it again didn’t reach to him as his office was locked. Now the lawyer told me that we can’t do anything in it as the notice didn’t reach the owner and his office is closed. He said police won’t go to his office address as there is no one who accepted the notice. He then said me frankly to give up as the police don’t even look for the cases of such low amount cases most of the times. Now I know it may be a low amount for many people but I just started this business last year and it was a big setback for me. The client does not even picks up my call now and just leaves me on seen on Whatsapp. He doesn’t even bother to reply.
Now I purchased the goods by paying the tax and also sold the goods in a legal way by paying the GST to the government and now when my payment is stuck the government has raised its hands up. When I look into news that Saif Ali Khan was stabbed and around 10 police teams were behind the culprit and caught him within 3 days I feel like there is no respect for a middle class person here. I do believe that the person who stabbed him must be caught but the government must work equally for all other crimes as well regardless the class. Even I pay tax too. Just thinking about it again fu*ks my head.
PS: Just going to my lawyer to pay his fees for the notices, yeah fu*k it! -

January 21, 2025 at 12:55 pmAlso the biggest joke is of MSME registration by the government. On ground if you see thare are hardly 10% people who purchase goods from MSME registered businesses (at least in my field of line). A minimum of 60 days of credit period is taken by most of clients. So yeah fu*k that too :’) -

January 21, 2025 at 1:14 pmYeah, our system is maddening. Regarding Saif, I had the same thought. I read somewhere that 150 cops were deployed for his case! Clearly, being rich and a celebrity makes life easy in this country.One way I’ve successfully gotten my money back is by calling partners or nearby shop owners, informing them of the situation, and nicely asking if they can help. Even fraudsters want to maintain their reputations in front of neighbors.
By the way, how much are you going to pay the lawyer for the notices?

January 21, 2025 at 1:29 pmWhat pains me more is that the fraudster can be caught by just tracking his mobile number but police won’t even do that. Was already fed up by increasing taxes and inflation in this country but still loved the country somehow, but now I have begun despising it even more than I loved. Just want to escape this shithole country now.
Also yeah I paid around 6k for the notices.-

January 21, 2025 at 1:49 pmleaving is better for your mental health. This country is run by poor people for thier immedeate pleaseure not for country’s benefit. Those whose grandparents pulled themselves out towards middle class feel like they will fall back to poor class. Meanwhile no support for them since only middle class is capable of taking risk and starting business and imporoving condition of country. It’s a real shithole.

January 21, 2025 at 3:33 pmLawyer here.Last know address as per ROC data is deemed as valid service. Further, you are MSME register, raise a dispute there, this is assuming you were duly registered at that point of time. Penalty under msme is compounding interest.ย

January 23, 2025 at 7:14 amThe problem here is that cheque bouncing is an economic offence and not a serious crime such as night house break in with weapon. To put it into context, the maximum penalty for breaking in house to commit theft and assault is 14 years in prison whereas in cheque bouncing cases even if convicted, judges are very reluctant to sentence the person to prison.Also in your case the amount is too low.. real problem here is not that the government agencies and courts will not pay attention to your case.. the real issue is that if you want to take this to court you will end up spending more than the cheque amount on lawyers etc.
