April 22, 2025 at 10:48 amMy mother-in-law had cancer and is now cured. The medical bill was around 12 lakhs. Acko initially declined to pay, so we sent them a legal notice through our lawyer. After receiving the notice, they started paying the claims. Now, the lawyer is demanding 20% of the claim amount as fees. Is this a common practice in Tamil Nadu? If anyone can help, please let me know. -

April 22, 2025 at 10:54 amwere there any agreement between you and your lawyer regarding 20% claim be it orally or written?
usually In Tamil Nadu, as in other states, retaining a lawyer on a percentage fee basis is quite common, especially in cases involving insurance claims and compensation.-

April 22, 2025 at 10:57 amPlease see the base council code of conduct. It is prohibited for a lawyer to charge fees on the outcome of a dispute. Therefore charging a percentage of the claim amount is clearly prohibited by the code of conduct. There is No way he can enforce it and collect the money. Consult another trustworthy lawyer. If push comes to shove, approach the local bar council with a complaint.-

April 23, 2025 at 2:38 amSome lawyers in Bangalore have started this trend of claiming a percentage of winnings. They take fees as well a percentage of the outcome. Trustworthy lawyers are there but they are a rare find.-

April 23, 2025 at 9:40 amThis is not permissible. You always have the liberty to change your counsel. Better clear these issues in the beginning only before you engage your counsel.

April 22, 2025 at 12:06 pmI’m an insurance advisor. If you do not mind, please givr some info. What was their reason for claim rejection? And how old is the policy?-
PParidhiknight553
OP
April 22, 2025 at 1:23 pmThe policy was only 2 months old. But acko insurance had no waiting period. They said claim was rejected because it involves invasive surgery but it wasnt
PS : I am genuinely telling we were not aware of cancer before taking the policy.

April 22, 2025 at 3:28 pmOk. I think Acko usually does medical tests also to the insured members. Glad you are able to get it sorted. -

April 22, 2025 at 5:50 pmWhat if it was an invasive surgery? As they have no waiting period, anything should be covered. Is there any clause regarding invasive procedures?
Asking as I have acko for my parents. Also, if you don’t mind, can you explain what was the condition and what the treatment was.-
PParidhiknight553
OP
April 23, 2025 at 1:32 amThey didnt go for platinum, so there were no tests. So they had waiting period for set of conditions. If it was invasive, then they would have rejected. Since that had waiting period. Where as for my parents , i went with platinum so they have no waiting period

April 22, 2025 at 2:28 pmNo its not normal.Depending on the lawyer, the fees for sending notice vary from 500 to 5000. Not more than that unless he’s a high court / supreme court lawyer.
Refuse to pay politely. And pay an average amount.
