        I have a sister who got married five years ago. Since then, her in-laws (mother-in-law and father-in-law) have been subjecting her to domestic violence, and my brother-in-law (Jiju) never supports her. Instead, he always takes his mother’s side.

        A year ago, my sister gave birth to a baby boy, but the fights in their household have never stopped. She has repeatedly asked my Jiju to live separately from his parents, but he refuses and insists that she must obey whatever his mother says. His father has even threatened my dad.

        For the past five years, this cycle has continued—constant fights, my sister coming to our house for a few months, then going back, only for the same situation to repeat.

        We don’t want any financial settlement or anything from them. We just want our sister and her son to live with us, without any interference from her in-laws. Is there any legal action or step we can take to ensure that her in-laws have no contact with her or her child?

        What can we do against them? They have harassed my sister too much i want them to repent

              Most Indian men (I’m men too) doesn’t have balls to stand up to their parents.

              If he stays with the girl’s parents and is treated the same. Will he endure it?

                    They want a housemaid not a ‘bahu’ .Her mother-in-law is extremely controlling and restrictive. She never lets my sister leave the house or go out with her husband. It’s a typical Marwari family setup.

                    Unfortunately, things have escalated – my father-in-law has verbally abused my sister on multiple occasions. And to make matters worse, her brother-in-law even tried to attack my mom

                      if you can manage to get a lawyer, ask them for the right legal action that can be taken.
                      However, it won’t be an easy fight. You might need a lot of legitimate proof to support the claim and convince the court to let her child stay with your family.

                        You can take multiple legal actions against your sister’s in laws under the BNS, BNSS, and the DV Act to ensure her protection, as well as claim maintenance for her and the child. The exact sections under which complaints can be filed will depend on the specific facts of the case. Regarding your concern about preventing interference from her in laws, you can approach the Hon’ble High Court under the writ of Mandamus, seeking police protection for your sister and her child. Additionally, a domestic violence complaint can be filed to obtain a protection order.

                          Why doesn’t genuine cases like these get the same attention as fake cases? I see few fake cases of harassment on guys and their life is ruined why cant the same be done in genuine cases. I really don’t understand. The law is women centric so definitely it should be easier for genuine cases right?

                              Tell your sister to come and live with her parents along with her son. You don’t need to take any legal action for it.

                                  If your sister has proof of physical abuse, file a case of divorce the next time she comes home. Don’t worry about the kid. Mothers are typically given the custody of their kids in these situations so it is very likely that the kid will be given under your sister’s custody. And most importantly, do not worry about what others might say. It is society’s nature to talk and judge. She is your family and your parents’ blood. Nothing tops that. Stick together and fight together. There have been many instances where divorcees married a second time and found a better partner.
