March 30, 2025 at 10:13 amHey everyone. Need your help and suggestions. My father and mother have a independent ground floor house owned jointly by them and we are living in it presently. On the first floor of that I have made a house for which I have taken home loan on my name and repaying through my salary with about 9 yrs left off it. My father passed away sometime back, without any will or testament. We are 3 of us now, mother, self and unmarried sister(mentally retarded, can’t read or write). My mother keeps telling me directly or indirectly that at least my father has left her a house to live for her old age and she’s the whole sole owner now.
I want to know the legal rule positioning here and what are my rights regarding succession.

March 30, 2025 at 10:27 amWithout any written will you, your sister and your mother own an equal share of the house. The area for which you have taken a loan, that’s yours.-

March 30, 2025 at 11:21 amDo we have an equal share like 33% each or since it’s owned jointly so mother already has 50% and rest 50% will be split between 3 of us?-

March 30, 2025 at 1:48 pmOnce mother is gone, property will be ultimately yours since sister is specially abled. On another note, take good care of mother and sister. Money will come and go but once family is gone, they will never come back .

March 30, 2025 at 3:32 pmI know what you are saying. And trust me I do take best care of them in my capacity and do everything i can. Even give my 30 percent of salary to her and I really don’t want to think of all these things. But she keeps bringing this up frequently as if she’s hinting me something. I discussed this with her lot many times that not to bring up such topics and we are a family and shouldn’t think of all this but no effect. Idk what she’s upto, maybe it’s a way to hint me that not to consider her weak or something and if i do something out of her wish she will deprive me of this property.
