March 30, 2025 at 10:04 amHey everyone. Need your help and suggestions. My father and mother have a independent ground floor house owned jointly by them and we are living in it presently. On the first floor of that I have made a house for which I have taken home loan on my name and repaying through my salary with about 9 yrs left off it. My father passed away sometime back, without any will or testament.We are 3 of us now, mother, self and unmarried sister(mentally retarded, can’t read or write). My mother keeps telling me directly or indirectly that at least my father has left her a house to live for her old age and she’s the whole sole owner now.
I want to know the legal rule positioning here and what are my rights regarding succession.

March 30, 2025 at 10:14 amIf I am not wrong, you took a personal loan to build the house, as it is an independent house only the ground floor is the real thing, first floor, second floor , terrace are all in name sake ( No legal existence). As your mother is the owner of the ground floor – she is not wrong in saying whatever she is saying. -

March 30, 2025 at 10:56 amNAL,After father/husband passed away, mother/wife becomes the first legal heir before children and for your situation – your mother is the rightful owner at the present and since you have paid for the construction- you will still need more documentation to claim ownership of the property adding your payments as supporting document.
