UI’m 29M, me and wife were on manali trip. We were going to hidimba temple, one guy gave us coupon saying that we can win a price we just need to listen for their company’s offer. They convinced us to buy their holiday plan costing 75k on 24 months emi. Now after coming back to our hotel I saw reviews and more than half people are saying they are frouds and they do not do anything as promised verbally infact they don’t even provide holidays. Now we want to cancel that memebership. Which as per their agreement clause will cost us processing fee of 20k plus gst. Till now only75k is blocked from credit card but the payment is not settled as per the SBI customer care and they told me wait 24-48 hours before transaction gets settled then they will be able to tell if its emi is made or its has been deducted at once.
I just want to cancel membership and get full refund but most probably they will deduct 20k plus some tax even though i have not used any service and no such processing fee was told verbally but it is in the agreement which they did not give us time to read. How should I go ahead now? What happens if I report this fraud to bank? What happens if they deduct 20k and bank does not agree without proof that it is a fraud since we swiped our card. What happens if I do not pay that credit card bill if bank does not agree that this was a fraud?
Please help our whole trip has become devastating because of this experience. Company is from Chandigarh. -

YDispute the transaction with proper reason. As you have yourself swiped the card the reason matters if the bank has to cancel the charge. Dispute with the reason that the terms and conditions weren’t properly explained and that you came to know of the malpractices of the company after you completed the transaction.

UMy concern is how do I prove just based on some reviews that they are doing this fraud. Since they used swiping machine and I put PIN does that make this fraud claim nill?

SJust say you didn’t understand what agent was doing. That he made you sign up for what you thought was lottery and took your cc details for verification and small token of money and you didn’t know it costed 75k.

PHappened to us with club Mahindra. These guys are useless and scamsters. This happened long back. Couldn’t get money back then despite relentless efforts. Maybe you’ll have success nowadays with improved fraud report mechanism.
Interested to know the solution on how this can be handled.-

PThey entice you in with a free gift by saying some lucky draw etc bullshit. When you reach there, they give you a cheap set of tea cup or plates. Now they sell you a membership in yearly charge advertising free stays in luxury resorts, holidays etc. In reality, you end up paying membership and the hotel charges and it is just not worth it.
Even if you plan a holiday yourself and spend in a smart way, you won’t even spend as much as they charge for yearly membership.
They try and sell you a dream, a lifestyle based and free perks (which won’t come).
In my case, we spend 75k in the year 2016 and got a holiday to Coimbatore. The hotel was ok, and had to pay for food, room heater because of cold, and the sightseeing charges when I reached there and had to travel there myself on my own charge. I realized in the end that I was scammed out of my money. Even if I had stayed in the same place and availed the same benefits, I would have spent a quarter of the yearly membership cost paid.
Now when someone says that they have a gift, I just collect it and run back home. -

USorry to hear but you have been sold a timeshare. They will promise the moon and pressure you to sign the agreement. The only option left is for you to get out with the cancellation charges and take the loss. Consider it a learning. You can cancel any recurring payment on your card. It is not a fraud as you willingly entered into the agreement.

UThey told me that there have not been any emi initiation but I have paid 75k yesterday. And only after settlement they will be able to tell if thats emi initiation. Also will they agree to fraud or they have to agree even if I paid that?

HI don’t think that the credit card guys are not scamming.
This is how the system is set up that once a transaction is made, only the merchant can cancel it, otherwise everyone would buy things, go home and put a cancel request-

People after buying raise chargeback , this is why card company wants to avoid in between dispute as sometimes the liability gets on the company for not doing KYC or etc.

So they just want it to be between the buyer and the seller and get their hands clean

If you order from Swiggy, zomato also and they do not issue any refund just tell them you will raise chargeback on the card and see their tone change -

UI think better would be lost stolen card since they are running a scam even they can’t prove that I entered it willfully and I paid for it otherwise whole modus operandi comes in picture?

RLost card will save you from thousands of explanations and justifications and what not. Lost/stolen is the silver bullet.

HOP has already called the bank and said that they did the transaction, at least that’s what I’ve understood from the post.
When the bank does an investigation, they will find that out.
I hope it works out for OP but I’m reading on other sites that“you cannot simply get out of a financial obligation by doing a chargeback just because you want one.
If a chargeback is claimed and processed but the seller can then prove to the bank etc that the purchaser DID enter into a binding contract under which the ticket purchased was non-refundable, then it WILL get reversed back out again.”

UHappened the same with Club Mahindra. They are scamsters of the worst kind, vile lying creatures called holiday advisors or whatever crap. Within 5 days I told them I want to back off , after they told me there is a 14 day total refund policy… l never heard a word from them again. Keep getting calls to renew the policy every month and boy do they hear an earfull from me.

BThis is classic club scam just different company name.
You won’t get any refund from company. Your best chance is credit card payment reversal.

KYou send an email asap disputing the transaction.
Ignore what customer care is saying for now.
Add an email request asap.Also, I found these guys on Google Maps and added a shit review for them.

UGuys during my research on topic i have also came across a community which has all the people who get scammed. They assured me this raising dispute thing with credit card company will work. Even if it does not they said they have helped other people to get refund legally also. I have just contacted them . Other people can also contact this number 99710 65367. They did not ask me any money only other information which maybe for understanding modus operandi of this particular group. Also to join their association thats it.

UHoliday Club scamsters must be operating in many tourist destinations. I barely escaped one in Srinagar. They had their touts snagging gullible people on the road with scratch cards offering gifts. They would even pay the auto fare to take you to their office or whatever (in this case a very big hotel near Dal Lake), make you sit and listen to their castles-in-the-air offers just to get hold of your money. I recall a sweet-talking bitch spouting unlikely promises of discount on every air ticket to umpteen places per year. Her attitude changed as soon as we refused. Good riddance.

UIn my case, the scratch card offered a discounted stay in Goa. A non-transferable document. We didn’t go. The other ‘probable’ gifts on the platter were a camera etc. The idea was that they never gave you any tangible benefits of listening to their rigmarole. And yes, it was my wife who got us in the mess by accepting the auto ride to the hotel instead of continuing to stroll along the Dal Lake.

UI kept telling my wife on the way that you will get option C nothing else. Which was same 2N 3D stay. Which happened to be the case.

UIt’s fascinating also how these scammers with their experiance have learnt how human brain works. He wasn’t even interested to bother me. Kept talking to my wofe. To me he gave the reason ki temple me 1.5 hrs ki line hai sir baad me rush kum ho jata hai tab tk aap sun hi lo. Jis pr I went along with her.

UHow exactly is this a scam?? Nobody forced the OP to sign up for the timeshare. I am sure no one held a gun to his head. I know people will downvote me but others are asking him to straight forward lie to get a refund.

UBecause they are not providing the services they are claiming for the amount that is being given to them. I pay you, you give me services. If you just keep taking money and don’t give services it is a scam. This has happened to thousands of people who gave lakhs of rupees to avail no service for years or not getting ehat was promised. I might be lucky i did not pay lumpsum, i never would have such amount but there are people who did that and got scammed.

UThey are themselves telling now its btw you and company you can go legal route they don’t care. Must be having few cases already.
