        Had booked a domestic holiday trip from MMT for 5 days costing about 70k. As per the itinerary provided, we had cab services for all 5 days. But during the trip they failed to provide cab services for local sight seeing. Even after repeatedly calling the customer care there was no reasonable response. Post trip they are offering a refund of mere 2k.
        Need advice on:
        1. Whether filing a consumer court complaint through lawyer would do any good coz I read in other threads here that they do not respond to notices.
        2. Which is better? NCH website or a notice through a lawyer or both?
        3. Or should I accept the 2k and move on?
        Appreciate any help on this regard. Thanks!

          Hi. Lawyer here. You should send them a legal notice regardless, stating there has been deficiency in service by them under the CP Act, 2019. Ask for compensation towards mental agony also. Basis the outcome and whether youโ€™re ready to pursue it, decide whether you wish to file a consumer complaint or no. You can file it where you reside.

            If you used a credit card to book the trip, i would suggest to raise a dispute transaction request due to services not provided, after some investigation bank will refund the money in your card, it usually takes around 60 days. But they give temporary credit too so you don’t have to pay the bill on this disputed transaction until a decision has been made.

                what investigation bank is going to do on this, and what findings bank is going to expect?

                    Well, they will first aeek response from the vendor then afterwards will ask for details of the issue from the customer. Any written correspondence will be helpful here. Afterwards they will make a decision. In case of no response from the vendor the claim is passed automatically.

                            They can’t just like, they will have to show proof. Simply claiming something won’t work as outside of irrefutable proof by the vendor this claims are usually awarded to customers.

                      Start with https://consumerhelpline.gov.in/public/ most of the issues get resolved here. If its not go the notice route

                        accept the 2K
                        then get a lawyer to file a suit in consumer court.

                        the refund works as an acceptance of guilt. all you have to prove now is your turmoil was more than the 2k they have provided. also, they should refund any money you paid for travel there, and emotional distress caused by the incident.

                        also, if you promote the fact that you are suing mmt, youโ€™ll get solution faster. but the court must not know you are advertising your case in social media.

                        id recommend get a nephew or a niece to run a campaign

                            Wouldnโ€™t the acceptance amounts to dispute closure and subsequent redressal; raising a complaint thereafter can be misconstrued as an attempt to extort more money from the company subsequent to the receipt of the stipulated refund.

                                yes it would seem in the first glance, and most lawyers would dismiss by saying so, but op also tried multiple times and the main issue was the harassment due to denial of service. it wonโ€™t be redressal because there were no discussion regarding how much money the op should have been paid, That was an arbitrary decision by mmt. Plus, mmt was notified as soon as it happened, as per op there were neither replacement for five days nor reasonable response. thus it canโ€™t be redressal, more like sweeping under the rug.

                                also, id say that regardless of where op was, 5 full day cab service would cost a lot more than 2K
