        Hello. I am trying to move out of this house which I’m paying 20k rent and there’s a deposit of 60k. Few things to mention beforehand:
        ● Agreement is for 11 months
        ● We are 4 students living as tenants

        So, 9 months in, I asked her if we could pay for the 10th month and could we leave for which she said no which is understandable. We have our personal reasons to leave and she wasn’t getting our “justification” on why we are leaving early. So I said fine, we’ll pay till 11th month (or, as another option, not pay from the 10th month and she can keep the deposit for which she said she’ll think about it) but we will be leaving. For which, she’s saying that that’s not possible either since “no other house owners give out their house for rent for less than a year (she means 12 months)”. She’s saying this was discussed in the beginning but none of us 4 heard about the 12 months part, at least, we thought she would be meaning 11 months whenever she says 1 year.

        So now, she wants us to pay till 12 months (or as I mentioned earlier, she’ll cut from the deposit and not return it) and an extra month’s rent for damages, painting etc.

        What can be done here?

          I know this is a tricky situation. She is correct that many house owners practically don’t give less than a year. However government mandates that leases more than 11 months need to be registered so she may have not given a 12 months lease to avoid registration costs etc

            That sounds really frustrating, especially since it feels like she’s changing the terms last minute. If your agreement is for 11 months, you shouldn’t be forced to pay for 12. Holding back the deposit for “damages” also seems sketchy unless there’s actual damage beyond normal wear and tear. Maybe try to negotiate calmly in writing, reminding her of the original agreement. If she won’t budge, looking into tenant rights in your area could help—sometimes just knowing your rights makes a landlord back off. Hope it works out for you.

                        1. Check the agreement for notice period clause
                        2. Provide her an official notice period in writing, preferably mail, in case the default notice period of 30 days is mentioned
                        3. You can leave on end of notice and she would be obligated to return the complete deposit after deducting the painting and damages charges, which is usually capped at 1 month rent in case of no major damages done by you.

                      What is written in the Rent agreement?? Usually its 11 months with 6 months lock in period meaning, either party cant break the agreement for lock in period, in that case loss of deposit will happen.

                          There’s no lock-in period or anything, it’s just a 11 month agreement

                          Ur deposit is 60k. Rent is 20k. Just don’t pay rent for 2 months. Tell her u won’t pay and to deduct from deposit. Don’t ask her. If she has an issue. Say not ur problem. What is she gonna do? Threaten to kick u out? Even if she raised a case against u in court, it’s gonna drag out by which time u would have left.

                              Can I stop paying rent right now, then? (She’s holding 3 months of rent, which will cover the months left and the maintenance cost as well)

                                  Technically yes. But anyways u gotta pay 1 month “painting charge” like it costs that much.
