        Hi everyone, Iโ€™m in a tough situation and need advice. My family and I have been living in a leased house, and our lease agreement officially ended in January 2025. The house owner requested us to vacate by March 2025, which we agreed to and have made all necessary arrangements to move out.

        We paid a lease amount of โ‚น5,25,000, and now that we’re vacating, we’ve asked the owner to return this amount. However, he has informed us that due to a divorce dispute within his family, he wonโ€™t be able to return the money until February 2026. We are in urgent need of this amount and canโ€™t wait that long. If he doesnโ€™t return the lease amount soon, Iโ€™ll be forced to take a personal loan at 20% annual interest as I need to pay back the money to a frd who I borrowed from.

        This situation is causing a lot of stress. What can I do to legally or practically resolve this? Has anyone faced a similar issue?

        If I go through legal route, how long will it take to find a solution, and how much will be legal expenses, if it takes more than a year it would be meaningless for me to purse leagl route.

          There is only one way you can make your tough situations to best. You shouldn’t leave the rent residential house unless he bring eviction order from the court.

            There are two solutions. The second one is tricky.
            Firstly you can get issued a legal notice demanding the amount within 15 days.
            Secondly, you can file a police complaint against the landlord stating that he has assaulted you when you asked for the lease amount.

              Do not vacate until you have the money in hand. Once you move out, you’re done. For he can keep delaying the payment as long as he wants.

              If you’re still planning to vacate, consult a lawyer first. Ask for a dated cheque or a promissory note, as advised by the lawyer.

              Again, once you leave the premises, youโ€™re completely at his mercy. Civil cases are painful, expensive, and can drag on for years before getting resolved.
