        I heard that divorce cases takes upto 20 years in india, even-though am victim of adultery and fraud by my husband, i don’t want to suffer in this shit for more years around court as i already wasted my life with him, what are your experiences in indian divorces as a women and what will be the wise strategy to end the marriage? Please advice me, its a 2 year marriage life with no kids and him involving in adultery throughout our marriage and we are currently in different states in USA and i have solid proofs of his adultery!!!!

          I’d say if you have solid proof, and everything arranged, then it mostly depends upon how much your advocate pushes it and how the judge is! Still might take years.

                hey advocate this side,

                Your situation is actually much simpler than a typical Indian divorce case and definitely does not need to take 20 years. Let me explain why. Since you have been married only 2 years, have no children and have solid proof of adultery, you are in a strong position legally.

                You have two clean options.

                First, mutual consent divorce under Section 13B of the Hindu Marriage Act. If he agrees to settle this quickly both of you can get divorced within 6 to 18 months. Given his adultery he may prefer a quiet settlement over a contested case. Second, contested divorce on grounds of adultery. Since you have solid proof this becomes straightforward. Courts treat adultery as a direct ground for divorce and with strong evidence cases move faster than people expect. Since you are both currently in the USA there is also an option to file for divorce in the US state where you currently reside. US divorces are significantly faster and Indian courts generally recognise them. The no kids and short marriage duration also means maintenance and asset division will be relatively straightforward. 20 year divorce timelines happen in complicated cases with property disputes, custody battles and no evidence. Your situation has none of those complications.

                    File it in USA. It takes leeser time there.
                    In India, contested Divorces do not follow any timeline and can get delayed.Β
