May 6, 2025 at 2:31 pmI recently bought a used car for 2 L and paid half the amount as cash and the other half as cheque marked with a future date, I inquired about any pending dues and there are around 40k pending on car, I have been trying to contact the seller to clear the dues so that i can get the noc and complete the ownership transfer, but he is not picking up my calls. I am worried that he is trying to scam me by not clearing the dues and also issuing the cheque. Can i cancel the cheque as a precaution so that he is forced to clear the dues first, can he file a case against me of bounced cheque ? -

May 6, 2025 at 2:35 pmCancel the check anyways. If a legal case comes, the other person will choose to settle as he will realise that settling you 40k and resolving it is better than giving money to lawyer to fight against you.-

May 6, 2025 at 2:47 pmThanks, but the thing is i donโt want the risk of getting into legal trouble over 40k, since i am a working individual and it could negatively affect my background checks-

May 6, 2025 at 2:47 pmHi. Iโm a Delhi based lawyer. You must stop payment immediately. Even if he files a cheque bounce case, if itโs proved that the payment was stopped owing to valid reasons for having a bonafides dispute with the complainant and there were sufficient funds in your account, you wonโt be penalised. Why donโt you communicate this to him via email and ask him not to deposit the cheque without clearing his dues.-

May 6, 2025 at 2:56 pmThank you for your advice. I was wondering if thereโs any way I can substantiate the genuine reason behind my decision to cancel the cheque, so that I have supporting evidence should the seller attempt to pursue legal action against me.

May 9, 2025 at 4:12 amYou can ask your bank to not to clear a specific cheque it is called cheque stop I think. They can deposit the cheque N number of times but it won’t be cleared by your bank
