April 5, 2025 at 8:03 pmI need legal advice regarding a situation involving the purchase of a flat. The builder of the flats took a loan from a bank, mortgaging the land, and subsequently sold flats to families. I purchased a flat, but the builder was unable to repay the bank, and the bank auctioned the land to a private company. The issue is that I do not have the registry for my flat. The private company offered me the option to buy the land on which the flats were built, and in return, they would facilitate the registry process. I made a partial payment (I have a check and the private company has the record of it), but the person living in the flat above me refused to pay, meaning the registry was not completed.
Now, I am planning to move out of this home, but since the registry has not been done, it is becoming difficult to sell or transfer ownership. I also have concerns that the family living above me might attempt to illegally take possession of my flat if I move out, especially since I do not have the official registry document.
Could you please provide guidance on how I can complete the registry for my flat? Is there any legal process I can follow to resolve this issue, and what options do I have to ensure my ownership is secure? Additionally, what can be done to prevent any potential illegal possession by the family living above me?
Thanks!!
