        I am a 23F recruiter in a company. I took this job last year (started as a fresher) due to limited options and also because of the company being certified as a great place to work. I was informed it was a one-year contract and thought nothing of it. Within 3 months of joining, I discovered that recruitment isn’t for me and that I don’t want to do continue with it in the longer term. Then I came across the fact that the contract is actually for 1.5 years. Additionally, the company offers very low pay and has constant layoffs.

        I am currently on the lookout for new opportunities. However, leaving early means either breaking the contract and paying a lump sump amount for a relieving letter (which I won’t be able to do so and that means leaving without the relieving letter) This makes me unsure whether to present myself as a fresher or mention my 7–8 months of experience when applying for new roles as I won’t be able to get the relieving letter. I need guidance on how to navigate this and apply for jobs without facing issues due to the lack of relieving documents.

          Did you read the contract before signing? 12 months becoming 18…..doesn’t sound right. May be you are not sharing correct info here.

              It was originally 1.5 years of contract only. I had misread it as 1 year. The company hasn’t lied or anything. But even if it is 1 year or 1.5 year, everyday in this company is getting difficult to spend. Therefore I just wanted guidance regarding should I approach myself as a fresher to companies for job change or what else can I do?

                  Approaching as a fresher without job type of positioning sounds better to me compared to claimed worked somewhere but no experience or relieving letter to support your claim.

                      That’s what I had in mind as well. I was just worried to start over on the same CTC again. Mostly HR positions don’t have a lot of budget to begin with. And anyways explaining my current situation to any company would be a task and I am not sure how to answer if they ask why are you a fresher even after 1 year of graduating MBA or why didn’t you join anywhere? Should I conceal my employment or how to answer that question?

                    Hey, lawyer here, my suggestions below:

                    1. Bond periods with liquidated damages aren’t enforceable unless the amount is reasoned. What this means is that if they’re forcing you to work for a minimum period of time, failing which, you’ll have to pay them a certain amount, then the contract is illegal. However, if they’ve spent money on training you or some certificate course you’ve pursued, then they can demand that amount.
                    2. Quit the place if you don’t like it. They can’t force you to stay. It’s given in the Contract Act too. But get an offer in hand first, and then quit.
                    3. Mention the 7-8 months on your CV anyway. No harm. If you have your joining letter or offer letter, there’s enough proof of you having worked there. It doesn’t matter whether they give the reliving letter or not. You’re not lying on your CV.

                      One – read the contract carefully to understand the separation clauses. Normally you will have a 0-3 month notice period.

                      Two – Even if you dont like the job – continue working for now. Start applying elsewhere. Please communicate the notice period you need to serve to your next employer.
