        Police took seized our bank locker keys and there was jewellery in that locker because there’s a Corruption case goingagainst my father from 2014. So it was gifted to my mom during her wedding by her father. Due to family problems my mother cut contacts with her father as he was abusive otherwise we would have a written affidavit by her father that it was a wedding gift.

        Now we don’t have any proofs that we have this jewellery as a gift to my mother during her wedding, no bill, no receipt etc

        So how to prove our jewellery wasn’t bought using black money?

          Are you in touch with any relatives or guests who attended your mothers wedding?

          An affidavit from them supporting your version can help prove the legitimacy of purchase.

          OR you can use the wedding pictures of your mother wearing the jewellery to prove your point.

              There was an aunt From my father’s side who attended his wedding but she was a child back then

                  I believe your aunt can still testify provided she remembers correctly.

                  A better piece of evidence would be wedding pictures.

                  Also as per my basic understanding of the law the burden is on the state to prove the jewellery was obtained from tainted money. So what proof have they put forward?

                      Regarding the testimony of your Aunt you can refer to Section 118 of Indian Evidence Act 1872. She is indeed qualified to testify.

                    In addition to this if you can get bank locker deposit records and if the records indicate that the deposit was made before the offence came into existence maybe then you can prove your version. Please note whatever I have said is not legal advise.

                        But wouldn’t banks don’t have the authority to know the content inside the lockers?

                            It won’t be conclusive but it can still serve as circumstantial evidence.

                            He was accused of approving poor quality material in construction of a building which resulted in loss of hundreds of crores
