February 8, 2025 at 12:11 pmMy girlfriend suicided last October.. after that my phone was given to nearby station for investigating as I was the one who last chatted with her.. and then the police transferred this phone to court.. now the case is closed.. and they said I can get back by phone by filing a petition in court.. can someone pls tell me how the process will be and the cost for it and also whether there is need for lawyer in this.. -

February 8, 2025 at 12:33 pmApproach a lawyer. A petition has to be filed to recover the phone. Tbh you should have done this while the case was pending before court. Because you’ll have to pay your lawyer to file an application, and on top of that, you’ll mostly have to grease some palms because the phone might have been “lost” and even then you may not get it back. The lower courts are notorious for losing files and documents. I hope you can get your phone back, but realistically speaking it’s a lost cause. I know a few people who have come to me saying the court lost their title deeds and they need it back. It’s a big process. Depending on your locality there will be different procedures for such cases. But even though I say this, file a petition you never know.-

February 8, 2025 at 12:49 pmIf the object is lost, they will never say it’s lost. They’ll say they’re searching for it so they can avoid the blame till you get tired of it and move on. It’s really sad but that’s how it goes sometimes. Like I said try your luck.-

February 8, 2025 at 12:55 pmThe thing is I was the last person who chatted with her.. she always used to have suicidal ideation as she had bpd.. even after her death her family had no issues with me.. but the police just because I am her boyfriend they really tormented me.. I showed everything in my phone when I went to give statement.. then they said they will be needing the phone to do a forensic scanning and then they will give it back in three days.. and I agreed upon it.. that’s where I lost my phone.. now it’s been four months.. whenever I call them asking about the phone, they were really rude.. and I was like why I am getting to suffer like this.. already I am grieving and the police are making it too much.. even there is nothing to blame or incriminate me, they just find fun in bullying.. I just need my phone back now.. all my memories are there.. already I lost her.. I don’t want to loose my memories too-
