CSo if you haven’t read my first part of the story it’s in my profile along with proof.
Today I found out my husband sent thar defamatory letter to all my relatives in which he accused me of being a man,a trans woman etc.
(Few months back in another petition he accused me of being a lesbian and few more months back he accused me of getting pregnant by someone ,despite having no proof of it)
I had sent this recent letter to my lawyer and he said it us good for us as he only is proving that he’s a psycho. In the letter my husband kept mentioning how he’s similar to atul Subhash and trying to milk his suicide to benefit his own madness and harass me more.
For context, I didn’t ask for any alimony or maintenance like atuls wife,on the contrary I didn’t even ask for the wedding expense of 20 lakhs that we spent. He is getting psychotic cause I dared to ask for my own jewellery back from him which he’s refusing to admit he has it.
His lawyer left the case after reading the letter he wrote about me. Now with no support from the court he is trying to defame me by spreading these letters to my relatives and my work place.
He had immediately quit his job after marrying me but now he’s blaming me for his incompetence to find a job. Am so tired. Honestly I reached out to broseph via WhatsApp earlier, insta too and no response when they had themselves told me to connect to them. Am feeling really down, can’t focus on work…all this stress and humiliation is making me feel life is worthless and actions won’t be taken against this monster unless something happens to me. (He had openly threatened to kill me). No one is paying any attention to this and it’s been more than a year am fighting this case. Despite having proofs against him,he’s roaming Scott free and threatening and defaming me. My lawyer is trying his best but the family court is too casual and keeps giving dates after dates. I am at my lowest and I am constantly threatened. Even the cops just took a report and nothing else. Am tired. I want to end it all at times. The name I worked so hard for,my dignity is being dragged through the mud by this psycho and no one sees it as an issue. What about my future? Am only 30. Do I even dare to dream of a future with no financial asset and these insults strapped to me?. -
UYou actually need to file a 498a under cruelty. Go to your lawyer. The section is for women like you. Use the letters he sent and ask police to file the case.

CInitially I had only applied for annulment as I felt he’s mentally unstable after I married him. I didn’t even file 498a and yet all mens rights activists had came up on me accusing me of torturing him like atul by his wife.(in my old account,now deleted due to the bullying by these men). I just want out of this and I feel filing 498 will drag it more.

UThere are evil people who misuse these laws and then there are good people like you who despite facing the problems won’t file the proper cases to have a peaceful way out. And honestly, if your husband was a dick about all this then that would had been an okay approach. But you don’t need to continue to suffer like this. Please use all the remedies law has provided to you

UFile a criminal complaint or FIR for the defamation and threats. A d file before magistrate if the police creates any problems. Also file against the in laws of they didn’t save you from the abuse that was going on and if they were also active in the abuse. A case against his parents should pressurise him enough to leave you alone.
I’m surprised a lawyer is not helping you enough with this, go to a lawyer specialising in criminal matters.-
CI will have to take this step it seems. What’s stopping me is him threatening he will commit suicide like Atul if I slap a 498 on him.

ULet him commit suicide. He’s not even 1 percent like Atul. He won’t commit suicide. And you have already registered the FIR for suicide threats (if you haven’t, do it before filing 498). It’ll be more than enough to protect you. Get ANTICIPATORY BAIL if he ever does attempt suice before the police reaches you.

Uthe bigger issue is not just his suicide, he could turn violent as well as most men do, so please be careful in taking your next steps

CThis is one of the reason am documenting it here. In case he kills me off like he threatened ,there will be proof of who did it.

UChange your lawyer, seems like you have an amateur and majbur advocate who has 0 connections. Be ready to loosen your pocket though if you are going to approach a good lawyer (Like 25000 per hearing) but it will be worth it.

CActually he’s a senior lawyer and taking 20k per hearing. My salary is 30 k, am struggling a lot. My lawyer is trying his best ,it’s the judge who keeps treating the case casually and giving dates after dates.

CWe just finished mediation last month with no result and the case is going to go back in court again. Its been a year since we started the process.

Uacha ok. but you spending 20k for a hearing is what bothers me without the case moving forward. my suggestion is- there are many young talented advocates who might help you out for considerably lesser fee. They take money upfront and won’t keep charging you for every hearing.

CYea but the case is towards the end now changing a lawyer is hard as my present lawyer is witness to all his acts and it will help in court.

USee 498A is a non bailable section while murder is a crime which is bailable.
Once someone has a criminal case against them, they are pretty much unemployable.
As he has already threatened violence against you, do you really think it’s wise to push his back to the wall?
There are many sections, but 498 is not the one.
And why did you even marry this kind of jerk?

BJust keep it to a side and focus on your life.
Indian Judiciary is slow and incompetent.
If you end yourself now, then what’s the point?!
1. He would win.
2. If you are going to end yourself, atleast do something to Change n Correct the System that Wronged You. You are only 30yrs old.Atleast this way no woman in future will be in same situation as you.

UReach out to pinklegal and on instagram, they will help you to the best of their capability. If you’re in Bengaluru, and the cops are not doing anything, go on twitter and tag them along with the previous report you filed. If they’re not taking you seriously, pinklegal will help you out with filing a complaint. Along with 498A, this calls for 405/406 and 499 of IPC.

UI’m sorry about that. Cops are your best bet right now. You have evidence, ask your lawyer to file a defamation case (499) and criminal breach of trust (405) for not returning stridhan. Take help of twitter if IRL is not working. Also, post it on your city subreddit along with the tweet. People retweeting it will bring more attention to your case.

FWhen you say your jewellery, is that jewellery given to you by your parents ?
If I am not wrong, In that case its your streedhan. And he will have to return it.

UUmmm…let’s assume she was a trans woman and the marriage is null. Annulment is exactly what she wants. However, her been trans woman doesn’t give the husband rights over her property right????? Even if she was a trans woman (she isn’t), her husband HAS to return her cash and jewelry. Keeping somebody’s property with you without their consent is theft! Her husband bringing up her sex here makes no sense.

RIs there any proof of him threatening to kill you openly? Any witness?
Have you filed IPC 503 507 against him?
Have you applied for IPC 405 406 for retrieving streedhan? What is the status?

CThe court mediator and the lawyers are witness to his threats. I have only applied for annulment but him harassing and defaming me so much is pushing me to file more cases on him. Waiting for the next hearing where I will present his disgusting petition to the judge.

RThen you should have an easy time pressing charges for IPC 503 507 against him. Now it is your choice if you want to do given the fees that you pay the lawyer. You could even employ the services of another lawyer or even the public prosecutor for this as this might be an easier case.
I was asking about have you pleaded for stridhan because that’s what you seemed to care about. So get that first and then he would be more likely for the settlement or mutual consent. If you pay the lawyers by each session then that seems the best course of action. The point is if you can establish somehow that he has your belongings which is you have a good lawyer, he should be able to during cross examination.
Your post has what he had done but the details about how you give about getting justice was not present. You can choose to share that info to kind of get a second opinion here. That’s your prerogative.
Whatever BS he is doing, the main purpose is to weaken you mentally. You do not get justice if you let his madness rule over you with out of control emotions. Get over that and you will actually have an easier way towards getting justice.
