        I have a terrible feeling that I have stupidly done a crime. So my ex bf became a peddler soon after we broke up and he used to peddle ganja and police caught him with 6kg amount of ganja but that probably didn’t make up a good enough case so they increased the quantity to 11.5kg.
        That stupid asshole, my ex. When he was caught, the police asked for his parents number to inform them. He gave them my number and they told me that they have caught him with 8kg ganja (quantity gets changed with every statement idk) and they asked if I was his mother and I SO STUPIDLY said yes. I don’t know why I did that and I feel so stupid for doing this. His parents got aware of this situation and his dad contacted me asking if the police had informed me. I told him the truth and then he said that he won’t let me fall for his sons crime.
        But now multiple people are telling me that I will be investigated for lying to police.
        His case has gone serious as charge sheet has been filed and he will(most probably) go to jail under the NDPS act. Please tell me how serious can it go for me. I’m shit scared because what if they think that I’m his business partner or customer. He got tortured to get the truth out, I just hope they won’t beat me.

          It’s alright. The chargesheet has been filed against him, and nothing has happened to you so far, which strongly suggests you haven’t been named as an accused. You didn’t do anything wrong and were just caught off guard in a stressful situation. Mistakenly saying something under pressure in a phone call doesn’t make you criminally liable, especially since the police later contacted his real parents and moved forward with their investigation. Statements given to the police during an investigation generally have no evidentiary value. Many people lie or turn back on statements given during the course of criminal investigations. So there’s really no reason to worry.

                  India is a dual consent country which means both parties have to consent to call recording. As you have (most probably) not consented to call recording, police have no proof against you.

                  Don’t take unnecessary tension in this regard. The more worrisome thing is to analyse if you attract such people only i.e. with trouble in background. If it is true, it won’t be good for you in long term. You need to seek therapy.

                      FYI, For call recording in India, we don’t require dual party consent. As long as the person recording the call is involved in the recorded conversation (aka single party consent)

                          NAL. Unless everyone on the call provides consent or the call recording has evidence of serious crimes like mur**r/ r*pe etc. courts reject the recording as evidence. Have seen this happening in actual court proceedings.

                    First talk to a lawyer. I don’t think anything will happen to you.

                    See I’ve grown up around people who do such things. And from what I’ve seen cops just want to arrest your ex. They don’t care about you because charging you would be another case which is not worth their time. If your lawyer and the ex’s father present your case you’ll probably walk scot free because again going through the procedure for you is not worth their time.

                    Worst case scenario they might ask for some bribe but nothing legal.

                      It won’t be an issue. It is unlikely that the police will proceed with any action against you.

                      By chance if they do, just say that you were threatened and were in an abusive relationship. Hence you got scared and told lies.
