SI found that my wife was having an affair with her brother in law (cousin sisters husband). I called him to confront and he threatened to kill me if I told anyone about it and ruin my life.
He may have said it in the heat of argument. I don’t think he has the guts to do anything. He later called me to apologize.
Can I send him a legal notice for threatening, i just want to make him feel that their are repercussions of what he said and did to me.

UJust focus on your wife for now. With the way laws are in India, you might end up putting your entire family behind bars by trying to teach someone else a lesson. He apologized, and that should be good enough. Tell your wife that you support her and suggest she marries him. If he refuses, support your wife in filing a rape case under the pretext of a promise of marriage—claiming he promised to first get her a divorce and then marry her. Always take your wife’s side and keep her happy, or she could truly make your life miserable.

UDid you get married in India or US? In US, you could have added a cheating clause to the prenup and could have gotten out scott free.
Laws in India are plain fucking dumb when it comes to infidelity from either spouse.
Whatever you decide to do, stay away from India or your wife will bribe police and judge to fuck you up.

WIf OP’s marriage was under HMA, then the US divorce has to comply with the tenets of HMA. Otherwise, the divorce can be disputed in India.
Also, wife has the ability to file domestic violence cases against husband from India. In such cases, the husbands passport can be suspended to force them to return and face trial in india.
There have been numerous cases like that recently where wife files cases from India. Just one ridiculous example below.
Also, under HMA, divorce is not 100% guaranteed just because the wife is cheating. The court can still deny divorce based on the circumstances of the case.
And also, wife doesn’t forgo alimony/maintenance rights because of cheating.
So, merely being in the US isn’t going to help if the marriage was under Indian law.

This is NOT the case, India cannot file an extradition request for a US citizen because they can’t prove the girl’s allegations made in FIR in US courts. If you can’t prove a crime, no American judge with an ounce of self-respect will give a minute of his time to an extradition request.
India does not have jurisdiction over the citizens of other countries.

WHMA has extra-territorial jurisdiction over Hindus married under the act. If one of the partners is still citizen domiciled in India, it doesn’t matter if the other has changed citizenship. Indian courts still have jurisdiction
The only way for India to loose jurisdiction in HMA cases is both partners changing citizenship and domicile to other countries
Even if the other partner is in another country, Indian govt can issue lookout notices against them over 498A cases and they would still be fugitives as far as India is concerned. As such traveling outside that country will be risky.

ZOP you need to come out of this mindset to teach any lessons to others. U need to heal. Betrayal is hardest to accept and it kills you from inside. Take up a hobby, take some time off for yourself, file for divorce and try best to move on. Leave those ppl to their destiny. Confide in your trusted family and friends, cry if you have to. This too shall pass.

UApart from everything else, forget your sense of self being undermined by some random twat (the guy) and focus on the possible offensive, because this time you might think you have the upper hand as you have them in the wrong based on circumstances. However, it is only a matter of time before she pushes forward with a separation demand based on false claims of domestic abuse to justify her having an affair. So lawyer up as soon as you can, and leave that possibility of you being framed the culprit redundant. Time is really of the essence here. And trust me, given the number of cases, that happens a lot.

HFile a Police case and have records of this incident. It might seem petty and will have no real outcome but will come in handy during divorce proceedings. Your wife at the time of divorce will make all standard allegations against you and having filed a police case first will be your favour. Please note that while you go back to US your wife may file cases against you and even arrest warrant may be issued without your knowledge. And when you come back, you may end up getting arrested at the airport itself due to pending warrant.

SI idea was to respond to the threat, give him a mental headache by sending him a legal notice and have him get a lawyer and go to court, I can throw money at it

PAdultery is no more a criminal offence. You can only seek matrimonial remedy through divorce on the grounds of adultery. Collect the evidence of her cheating and keep them safe. Threat to life – do you have the recording? If you do, you can go ahead and file a complaint with the police. They may not do anything right away saying that it was just the heat of the moment. But this can be shown in your matrimonial case.
