        My nana (mother’s father) built a house currently valued at 2 crore, where currently my mama( mother’s brother) lives.

        My nanu passed away two years ago. We live in Dehradun, Uttarakhand, where recently, UCC, along with inheritance laws, has been passed.

        My father helped my mama a lot during his early days of settling down, but now, when we are in financial trouble, he refuses to provide us with any financial assistance.

        We are considering filing a case for inheritance since my grandfather died without leaving a will. The property is worth 2 crore, and my mama’s family lives there along with my grandmother (the widow of my nanu).

        What are my mother’s rights in this situation? How ethical and legal is it to pursue this inheritance?
        Should a female claim her rights in her father’s property?

          Legally she can claim her share. Morally and ethically it’s between the family members and their past conducts.

                So they need to sell the property?
                Or it is it our own will how znd when we need the amount??

                    See you will get right of 1/3rd portion of that house, suppose if the house have 3 rooms your mother will her 1, and later your mother can do whatever she want, but she cannot block the passage for others, your mother can even sell it.

                      Morally it’s wrong considering indian culture. It’s upon you , your mother has equal right in that property.

                        Lawyer here based in Delhi. Yes, your mother has 1/3rd share as of now. But I think your dispute revolved more around smart negotiations rather than actually filing a suit for partition.

                            If your mamu doesn’t agree to give your mother’s share, then the only option left is to file partition suit.
