        Hello,

        I am not sure if the question is fit for this sub or not but I will give it a go. (Mods please feel free to remove if you feel so but I will really appreciate it if you let it stay here since I am desperately in need of some advice).

        Situation – Maternal Grandfathers property, he did not write a will before he passed away. Discussions are going between my uncles, my aunts and my mother for the distribution of money which would be a proceed from the sale of the property. My uncles are saying that although the law does state an equal share amongst all heirs, the prevalent practises/norms which are followed are not so. My uncles are offering a really good chunk of money to my aunts and to my mum but it is not an equal share.

        In general, they all get along well and they want to sort it with in family; Without going to court etc – In fact I think if my aunts put a united front, my uncles would just say take your equal share but I also think that it would destroy their relations forever (Not that it is relevant to law).

        My question – What is the generally followed and accepted practise in our country. Yes there is an equal distribution law. But in your experience, what do people in general do?

          The law is that when a person dies intestate (without a will), all legal heirs are entitled to an equal share in the property including the females.

          How much you guys want to take or give up is totally up to you. There is no standard practice in our country. Some people fully relinquish their share. Some happily take whatever they are offered. Some fight for years for their rights in courts. Some commit murder for a larger share.
