February 8, 2025 at 12:45 pmI recently resigned from a startup (25-30 employees) due to excessive stress and mental pressure. I chose not to serve the notice period, but now the company has sent me a threatening email stating they will take legal action if I don’t comply, as per the contract I signed during onboarding (6-7 months ago).Here’s where things get tricky:
– I was on a 3-month probation period, after which they gave me a permanent offer letter—but I never signed it. So, technically, I might still be on probation. During probation they had a month of notice period to serve, mentioned in the contract.
– The company has a history of unethical practices (cash dealings, using pirated software, and even receiving a legal notice from a software firm, after which they started using VPNs).
– They did the same thing to a former employee who also left without serving the notice period—sent a legal notice, but I’m not sure what happened afterward.Given this situation, what are my options? Can they actually take legal action against me? Has anyone dealt with something similar before? Would really appreciate any insights or advice!

February 8, 2025 at 1:01 pmMost likely, they wont take any action because such litigation would cost more to them than the recovery amount for not serving the notice period.
The downside is that you wont get any experience certificate and any background checks by future employer may result in negative feedback.-

February 8, 2025 at 1:38 pmI’ve asked them to pay me the amount for 12-13 days which I worked on which they asked me to serve the notice period. I guess, I’ll have to let go of that, only then it might compensate for the notice period.
