January 23, 2025 at 2:40 pmI think there are laws but they aren’t for use. They will be kept written.Right I’m facing a lot of problems. Here’s the whole story-
I’ll be in college this but my father is not paying for my college and expenses. Actually my mom and dad aren’t together. I’m the second wife’s only child. Also I have two step brothers who are now married (from the 1st wife). Due to domestic violence that my mother faced in her married life she left the house and now case is been going on from 3 years. Sadly nothing happened till now. My father is evil. He never treated me like his child. I was hated by him and his family. Since my mom left the house few years back my father and his brothers used to torture me every day. But I was living their because of my studies cuz my mom doesn’t have a job. She can’t handle all these expenses. So I have to live in such toxic environment. I did have also been beaten by them like my mother. Few weeks back I had enough of it and called police( Did my medical and report ) . But then I have to leave the house cuz they hate me more now.
So I left that toxic environment and came to my mom. But now we don’t have money. Still now my mom doesn’t get money for the maintenance. She is worried about my life. My father made a deal with me if I tell my mom to close the case then only he will give money for my clg otherwise he won’t. We can’t close that case. It’s important for us. Now I’m so confused what to do with my life. I had all the plans about the clg but here comes the another problem. My mom’s lawyer is saying that if we did start a case for me now then it will take 2 years approx. I already took a year drop. I can’t take more drop for it now.Even I’m his biological daughter still he’s not fulfilling the duties of a fathers.
I just need some advice that is there any law in india for such situation? Can I do something about it? Because I don’t want to waste my 2-3 years.

January 23, 2025 at 3:17 pmAdvocate here,You need a better lawyer; your mother’s lawyer seems incompetent.
You can try reaching out to an NGO that deals with such cases they’ll help you.
All you have to do is file an application for interim maintenance under 144 BNSS for yourself and also file a complaint under the Domestic Violence Act to claim remedies under it.-

January 23, 2025 at 3:23 pmnot a legal advice but Reach out to Indiacares twitter handle. They may help with college fees. Tell them your full story. They will verify it and some kind soul will pay for fees.
