One of my friend got married in feb 2023
In marriage the girl created problems behaving rude to boy family for sometime the marriage was halted to think that shall be proceed or not.

But my friend thought this is minor thing and got married.

After marriage then comes to her mental torture to my friend bcz why marriage was halted. In honeymoon also she abused him bcz his sister called around 7-8pm.

After this continued they shifted to a town where boy was working in public sector and girl also got transferred she also works as clerk in one of the public sector bank.

They hardly live around 3-4 months together and she left to PG for stay

In that month she abused him verbally physically. Then he contacted a lawyer she asked to get MLC done for that she scratched his neck many time and broken the small part of teeth.

After one yr he decided for divorce initially girl agreed for mutual but latter refused.
Her lawyer told him to file on the real grounds on cruelty.

He filled filled judge refers for mediation

In mediation she is asking 35lack alimony

She is working in public bank earning decent around 65k (boy salary- 1lack)
Marriage lasted for 3-4month after both living separately (short marriage)
He has 2-3 MLC on her name
Have video of verbal and physical abuse
There is no child.

What shall my friend do should he contest
And what is reasonable amount.

Can be contested divorce with proofs. Your friend (he) and his lawyer needs to prove in court. This process will take years, every next date would be atleast 1 month away in the beginning and would be 1.5 to 2 months in future as case ages.

My opinion if needed to decide in court, let her file as petioneer. Then she has to mandatorily come to court. Make her visit, make her give up after sometime. Not a good way, but our laws are with women. I don’t want to sound that way, but it is what it is.

If want to save time, close as mutual consent in the mediation then agree for an amount.

At the end, it is time + money vs money.

As she asked 35Lack my friend said he can go upto 15Lack, saying that there shall not be any alimony as you are earning well. Have stable job. She didn’t come for negotiations. What shall be next move ?

And how can she file for petitioner when he only filled as cruelty and initiated it firstly

Your friend has already filed on cruelty grounds. Now, he has to provide proofs and prove the cruelty in court.

BTW, alimony is two way. On basis of cruelty, your friend can ask marriage expenses, if any.
