January 16, 2025 at 8:33 amToday in our office, one of my colleague failed to do a task efficiently. Our manager had scolded her and insulted her soo badly, she was not eligible to even work in the office. He then asked her to serve coffee and tea to the management executives throughout the day as her punishment. I’ve seen her morale go down that day. She’ll definitely resign from the company as soon as she gets an offer from other companies.My question is that, was that even legal of what our manager has done?

January 16, 2025 at 10:01 amNALAlthough not legal, without concrete evidence it is difficult to prove. Even if person decides to file complaint, company will try to drag it . further the person carries a risk of tainting their chances of getting hired anywhere else.
I have seen and experienced worse than this without much recourse to employees.

There is no criminal liability however.Also, Visakha Guidelines are not being adhered to here, but then again, it’s India. LawyerΒ² this side.

January 16, 2025 at 10:17 amThe problem is that we as employees have given this power to such idiot managers by not speaking up, by not saying NO when needed and shying away from putting our opinion out there on the day to day activities.Such people get power over us because they know the other person is spineless and won’t utter a word.
Don’t get me wrong in saying that you should learn to say NO to your managers, it means that if you are uncomfortable in doing something, speak up.
You don’t have to be a jackass, respectfully, professionally tactfully say, *I appreciate you giving me this opportunity, but unfortunately I don’t feel comfortable in doing it. I think the Team/Company/Project will benefit most if someone else will do it*
What this will do is push back the managers and let them know that you are not the one who’ll keep quiet and follow orders just like that.
Of course, this has to be done in genuine cases and not just every time.
In this particular case, when the employee was not able to perform up to the mark, (happens to the best of us), she should have told the manager that with all due respect, but I did not like your tone. I understand my performance was sub-par. I’ll make sure I’ll put in more effort and get it to the level that it should be on.
And regarding serving coffee, she should have straight away said NO. Self Respect??
Speaking up is very important, keeping quiet will only worsen the situation. My 2 cents.
Been working in the IT sector for over 20 years now, my initial years were like that too, but then I made a conscious effort and started taking my stand against such stupid managers and building healthy relationships with all my managers.

January 16, 2025 at 2:45 pmThis is too much. And if your colleague complies with this BS without taking any action then sheβs encouraging such derogatory and predatory behavior.1. Ask her to complain to the HR in writing. Make sure she sends a BCC to her personal email as proof.
2. If no response received from HR, have her send a follow up email. BCC herself. If HR talks to her have her insist written communication. If it is a phone call – have it recorded.
3. If no action is taken against the manager, have her escalate it in writing. These will be proof that she sought justice within the company before going public.
4. High chances she wonβt get any support from the HR or from the superiors. Her life might get worse. Then have her put up a firm, bold post on Linkedin. Share it on Twitter as well. Tag the company and name the manager.
5. If sheβs harassed by the HR or the bosses, put those up as well.I know these are easier said than done but as I mentioned, someone needs to stand up against these a**h*l*s.
