        I’m seeking advice on how to proceed with a complaint against a judge in a lower court in West Bengal. We’re currently involved in an eviction case against a tenant who has illegally occupied our premises. My father, who is a witness, suffers from high blood pressure and had a difficult time standing after a long wait, during today’s cross-examination.

        The opposing counsel twisted facts, and when my father tried to clarify, the judge scolded him, demanding yes/no answers only. The judge even threatened him with contempt of court and potential imprisonment. What’s more, the judge asked my father to stand without support despite his visible struggles.

        As his son, I felt helpless watching him being treated this way. Now, I’m questioning the judge’s ability to ensure justice in our case. Can anyone guide me on how to file a complaint against this judge?

          Draft the complaint and address it to the Chief Justice of India (CJI). Alternatively, you can address it to the President of India or the Union Law Minister. However, complaints against Supreme Court judges are rarely entertained unless backed by substantial and credible evidence

            Consult your lawyer first.
            Generally, it is advisable to complain to the Principal District Judge/Chief Judicial Magistrate depending on the cadre of the judge.

              1. Get your father properly treated for hypertension
              2. In our motherland, complaint against judges will go nowhere, and can further worsen your own case
              3. Next time, sit with lawyer a day or two before to properly prepare for hearing. Trying to argue (reasonably or unreasonably) with opposite side is never seen as good by any presiding Judge

                  We did that with the advocate.
                  His advice was that all advocates are powerless against the judge, they can’t intervene.
