January 14, 2025 at 3:47 pmMy father thought of doing business when he was 40, I was 12 and his salary was 50k per month.
We lived in a tier 3 town, though we didn’t own a car we were quite happy in our lives.Little did he knew about the operational challenges that were there
1. The employees stole raw materials, and I’m not talking about one or two, all employees did it in co ordination. We changes all our employees twice but nothing changed. This led to losses of 1 lacs a month, all of my mother’s jewellery was sold and we were indebted.
So my father took another job now 40k per month in 2016 to clear our debt and we finally did.
2) My father tried his hand again in business in 2019 and this time he went a little big, he went to another state rented a storage unit, bought commodities worth over 1.5 crs, and stored them there.
The big businessmen did not like the fact that a man from another state is doing good in their state and he stole the commodities, sold them in cash, and plain denied his responsibility, never let us file a FIR and claim insurance. this led to a series of FIR in 120B, 138, 406, 409 and 420 IPC and CRPC.
Somehow he managed to navigate through all of the arrest warrants. Every FIR filed costed us paying 50k in bribe to police station to not arrest my father, and then another 15k to 50k to get anticipatory bail depending if we got bail from lower court or high court and then 1k per hearing to the lawyer.with corores of losses and a dead end, my father tried everything and took a handloan of 2 lacs from someone to restart his business find some good men, and restarted his business in 2021 after covid and everything. This time we started exports, and everything went great we went on to earn 1 corore a year in profits and our lives finally get on track.
3) For past 3 years everything was going good, but then it took a turn of events in november 2023 when he had a fight with a politically influential person, the person filed an FIR in december 2023 in CRPC 120 B, 406, 409, 467, 468, 471 and 506. My father was escaping arrest and filed for anticipatory bail in high court, on the date of our hearing in high court. The police crossed 3 states, without informing the police of Kolkata kidnapped my father in civil dress. For two days we were in a very bad state not knowing where our father is finally got to know he was arrested. They got him to sign on papers that he was arrested from a local temple. our business collapsed as he was the only one in family to know anything about it, Meanwhile in another FIR files during earlier phase, Someone involved my mother’s name in FIR, so my father spend 12 lacs and emptied all his accounts just before his arrest to get my mother name removed from the FIR.
Now my father was in jail, no money in our accounts, 1 lacs per month in EMI’s and no prior experience of handling the police or court.
When I went on his first bail hearing in the local court, the complainant tried to kidnap me and pressurize me into giving our car to him in order to get No objection for my father’s bail in court.
Thank god my uncle and my father’s cousin got me out in time, They did surround him to kidnap and pressurize him, but he was not next to kin and he dialed 112 and everything was recorded so he escaped somehow. Now after a month and half our bail got rejected from local court because the local lawyer we did never filed the required documents because he could not take on a locally powerful person. later we filed bail in high court, and little did we know that in 10 months our case will come in front of judge only twice, and one time the Government advocate took time to file counter affidavit and another time he did not appear. We have been given date 11 times in these 10 months and rest 9 times the file never went in front of judge.
On top of this all when I was visiting my father in june, the guy filed a FIR of attempt to murder against me, and tried to get me arrested, luckily the local administriation was fed up and the conservative extended family of mine which I do not like much used all their influence, somehow got me out without any consequence. I got FR from police station.
Now I have not talked to my father in months, My mother weeps all the time, my younger brother has fallen academically. I was about to do Sponsored Phd from NIT trichy with the backing of my institute director who offered me position JRF position in communications engineering. I wanted to do a startup, drive a BMW, but a penthouse by the sea. Now all I’m doing is running to courts to get my father out, meanwhile others have filed FIR because my father is not picking his phone, I have to run to other courts on his behalf.
Multiple lawyers means multiple fees.Now I have paid 12 lacs in EMI’s, 2 lacs in lawyer fees, 25k per month in our monthly expenses. and I could not do a job because Every week I run to courts because no private employer will give me so many leaves.
My career has collapsed, I cannot sleep, everybody weeps, everyone is stressed. All of mother’s jewellery has been sold again. our relatives has given us 7 lacs Debt. They all run with me whenever they can, because you cannot goto anywhere alone because people try to intimidate you the moment they see you alone.All of my peace is gone, I would just like to ride a splendor, drive a wagonR, live in a small house in 2 bhk, but I want peace now. I just gather myself everyday to do things, thinking one day things will improve.

All i can do is to suggest you that if Your matter is district court then always heir that advocate who has got connections with judges and is seriously willing to help you as a client, you can get orders in your favour in district court, if you have right connections, right people working for you and the right amount to pay. Kindly don’t lose your hope brother, its a tought and long battle to fight.All i can do is wish you luck and hope justice prevails. -

January 16, 2025 at 7:06 amLike the fight with some politically influential person, and that person filled soo many FIRs, that the cops had to do a sting operation to catch.
And also his business in another state, 1.5cr investment and then all the commodities being stolen by any big businessman and then he couldnโt file FIR and claim โinsuranceโ. And in turn FIRs were filled on him !!?? Those involving cheating and stuff.
And then again restarting a business with 2 lakhs and making a profit of a crore in such a short span for three year duration. And then again some influential person again files cheating cases.
This whole thing seems like as much as system is broken, there is some concerning elements of how he played the game in the system.

January 15, 2025 at 12:28 amHi, My dad was also kidnapped by 6-7 policeman/woman in civil dress, unmarked car. They crossed state boundaries, didn’t inform local police and for a day we had no idea where he was.Later they tried to show as if the arrest happened right outside the police station and no one came to my home town.
We got lucky because I filed a FIR for kidnapping and the local SP is on record clearing the matter that he was not kidnapped but police from different state came for him whereas that other police says no one came to my town.
We soon after that filed a complaint with NHRC, They did their own fact finding and we got a decision in our favor. (Fine on police of 2L and further action on people involved, the case is still in progress)
Throughout this process, The scum bags in MP Police, People in the MP DGP office and the DGP himself were lying about the facts and trying to get out of it.
And, You cannot trust district courts, high courts and even supreme court to some extent.
In our case, The opposite party was bribing local and high court judges to not hear our case or get a decision in their favor. In the supreme court, I guess they couldn’t bribe the judge so they were paying off the technical staff to make up technical problems when it was our turn. Multiple times, The case before us was heard, the case after us was heard but when it was our turn, Some technical problems would come up and the case was put for the next date.If it’s not too late and if you have any proof they came to your town, Please file a complaint with NHRC anyway. I don’t know what else you can do to make things better, I pray things will work out for you and your dad will get through this. Please stay strong.
Let me know if you want to read the NHRC response in my dad’s case.

January 15, 2025 at 3:26 amhrcnet.nic.inResponse time is often in months. They give other authorities 4-6 weeks to respond and every time the authority in question is given 3 chances before they’ll be summoned to NHRC offices and as you’d expect, They almost never respond before the final chance. So it takes at least 2-3 months to get a response and then another 1-2 weeks for NHRC to decide what to do next.
At least NHRC does listen to you and do their own research if you say 1 thing and the PoS police says something else

How long does it typically take for them to forward that complaint to the relevant authority? Do they send it out the next day, or do they hold onto it for a few weeksโsay, four to six weeks?
Essentially, I want to understand how long the NHRC keeps a complaint before forwarding it.

January 15, 2025 at 5:35 amI first sent the email and letters in January and they responded in the first week of April.NHRC asked both the police and my dad. My dad presented all the proofs and NHRC came to the conclusion, The police and DGP MP were lying. So, They are not relying on statements of just 1 side.

January 15, 2025 at 10:31 amThe process is still going on. DGP UP, DGP MP, DGP of Jails in MP need to file their reports, There were 2 CBCID investigations and they need to file their report. It has been 4 years since this happened.

Eventhough I can understand the ground reality, doesn’t bribing the police officers only add to the already failed system and fuel them to ask for more bribes?At that point complying to bribe and crying about the system is kind of an oxymoron don’t you think.

January 15, 2025 at 4:28 amJust wanted to rant, and I’m not even complaining about bribes. I was happy to offer it and get out.On an average there are 250 cases listed in high court on a particular day, a judge on a good day listens 100, rest to the bin. This is the main frustration

Even though, on paper, things are getting good, but socially, it is not that easy to do business or a job in India.However, if you spend 1 day in a police station, you will be absolutely shocked to see what kinds of cases come in.
I know that police officers are corrupt. I myself went through a frustrating experience recently. But, that 1 day (a few hours of a day) taught me a lot on how much people’s sufferings are, along with the police.
Police officers do not have any sleep schedule. And they always have pressure from the top. The only reason why police officers are not treated with as much respect as the Indian army, is because of so many corruptions.

I didn’t get a lawyer and fight back I just disappeared because I knew nothing would come out of it.The entire socio-economic and political scenario and system in this country is designed in such a way that there is no way a common man can have a prosperous and peaceful life.
Got even cheated and manipulated by a company where I was an employee and I made them crores of money but got nothing in return.
But somehow I managed to survive, somehow I managed to live and find a way.
I don’t like this country and I don’t like it’s people. I have a very small circle of people who I trust.
The vast population of this country makes it even more difficult to manage and have a functioning framework.
The sheer madness of the socio-economic and political condition are a total mess.
This country is lawless and will never improve.

January 16, 2025 at 7:05 amIts really not the judges… i know you are in no position to hear any justifications but it happens so often that lawyers do not file the cases with proper rewuored documents.Many times they do so deliberately so you keep paying them.
And other times they do not appear in court. -

2) Ingratiate yourself to some politically connected individual so you can always leverage their influence if required.
There is no scope for honesty or justice in India.

Also you don’t buy commodities without selling them.
First you find a buyer who is looking for something and then you find small sellers who are looking to sell

January 18, 2025 at 3:23 amThis breaks my heart. My relative has a small scale manufacturing unit in Pune. And they are in a similar situation. The local goons come over for monthly payment and if not paid they will cut water supply, electricity etc. Plus the judiciary system is unable to process their case because the amount involved is 40 lacks which is much Peanuts for them. We are taking care of their childrens education. -
