March 5, 2025 at 3:04 amHi,On 2nd March I saw one flat and paid 50k deposit amount to the manager of this place who works for the house owner staying in USA. After 2 days I got a job opportunity where my place would be in Indiranagar which is 15km away from my booked flat. I informed the manager this is the situation and I’m appearing for the interview. If at all I get selected then I cant move in to this flat due to travel situation so if he can hold on our deal or cancel the deal and return my deposit. This manager said its not possible and he will talk to the person A (whose post we saw on flatmate group for replacement) person A will have to pay the rent if he doesn’t find any replacement. Now the person A also got pissed at me and asked me to search for the replacement. He said they might deduct token amount of 20k which I think is unfair as such high amount was never communicated to me. I messaged the owner on LinkedIn the whole situation and I had checked with one lawyer in my circle who said they can’t deduct without my signed agreement, I informed the owner what I found out from the lawyer and requested him to return the deposit as I informed about my job situation within 2 days of paying the deposit. Now, this owner is being very rude to me and saying you spoke to the lawyer now you can’t talk directly to me and ask your lawyer to contact me. When I asked for his contact and mail then he said he will not share and lawyer will share notice to him and he is answerable to the court, not to me and stop harassing me and that I’m the one twisting my words. Clearly he’s the one being AH here. Can someone please help me here? I’m planning to go legal way but somewhere I have lost hope because I know in our country law is shitty and maybe no one will help me because the owner is a rich guy living in USA and I’m no one working here in Bangalore.

March 5, 2025 at 6:23 amI did not threaten him. His manager first refused to return. I tried explaining to the landlord that legally it’s not right. And yes I’m going ahead with the lawyer as they are not ready to return

March 5, 2025 at 5:12 amLegally, the landlord can’t hold your deposit without a signed agreement. Send a legal notice first, then escalate to consumer court if needed. Gather all evidence (payment proof, messages) to strengthen your case. The lack of a contract works in your favor here. Don’t back down — the law is on your side.-

March 5, 2025 at 10:59 amI have proofs of 1) gpay amount sent to him mentioning in gpay note that its a deposit amount. 2) They did not share any rental agreement when i paid deposit and shared it when i mentioned my job situation and i might have to cancel the deal that too with wrong date of agreement (jan 25 and i saw flat on 2nd march) 3) They did not mention anywhere in written about token amount being 20k whereas I’m willing to deduct 10k max if not for 2 days deduction as i informed after 2 days to which they are not replying 4) If the lawyer costs more I’ll take loan and pay and also charge the landlord for mental harassment compensation after discussing this with my lawyer 5) I have not signed any legal document agreeing to any payment if deal gets cancelled 6) I have chat communication proofs with the manager and landlord refusing to solve it outside court, landlord is super rich and stays in USA. They have real estate company. The landlord when asked what do you want to do? He replied- you’re twisting the words which clearly means he is intending to not return my deposit. After my job interview I’m planning to go to police station first and request the cop to talk to the manager otherwise I’ll go ahead with legal notice from my lawyer. One lawyer said nothing can be done due to verbal agreement but other lawyer is saying they also did not communicate any deductions or made me sign any legal document and false dates mentioned in the rental agreement so we can fight it in the court which will be long procedure.-

This time will help in building up legal tension and also serve as a document that you gave ample time to him before moving to court.

March 5, 2025 at 11:31 amI’m giving them today, The guy who showed me this place as his replacement said he will be talking to the manager for me and take deposit from the new person and give it to me, if the manager doesn’t agree then I’ll send the legal notice and I have interview tomorrow, I’ll ask the lawyer to send the legal notice tomorrow. As no token amount was mentioned initially he should not charge anything from me. Let’s see what happens. Im in a high stress situation and broke down in front of manager on call mentioning I’ll have to k—l myself if he dont return as im already burdened with job switch, shifting to another area etc and family’s responsibility being a single earning daughter. He disconnected the call and is not replying or answering now. -

March 5, 2025 at 11:33 amI’m planning to take help of a cop before lawyer, one lawyer suggested I can either directly send legal notice or first ask cop to help, I’ll ask my lawyer what i can report in police station because it clearly is a mental harassment if they are planning to deduct 20k or my deposit without my legal sign, documentation or when i clearly mentioned the level of stress i have which is pushing me to commit suicide-

March 5, 2025 at 12:04 pmI’m planning to send polite request of update from the manager to whom i made the payment and if he don’t reply then I’ll post on twitter tagging Blr cops and if cops also don’t help I’ll go on hunger strike if that option is available while sending him the legal notice. I’m so angry and stressed. Why can’t people live ethically and let others live peacefully.

March 5, 2025 at 11:00 amAgreement was not signed. I have all the chat and transaction proof. I have not signed anything and I informed within 2 days the cancellation so deducting 20k is unfair and doesn’t make sense.

March 5, 2025 at 9:53 amGpay upi payment and whatsapp messages where i have mentioned clearly its a deposit. He was supposed to send me the rental agreement but he delayed it and 2nd day when I got to know my job situation I updated the manager on text, he then sent the rental agreement back dated and not the actual date of march. No agreement was signed. It was verbal on call where I told him I want to finalize this place and asked him to send me rental agreement and he said i can pay the rent once I shift but I cancelled shifting-

March 5, 2025 at 10:11 amEither this needs to be mutually resolved between parties or police/legal will take long time and cost…. always they can argue that because you confirmed.. they didn’t allow others and lost potential takers because of you and token amount will be deducted and it is not against any norms..etc-

March 5, 2025 at 10:26 amBut they did not tell me any token amount how much they will take. They can take the token amount upto 5k or 10k i don’t mind because I updated within 2 days only. But charging 20k as a token without any prior information or legal documentation doesnt make sense. I understand legal way will take a long way and I also understand that if I had signed the rental agreement right after paying the deposit then they charging me large amount makes sense but I haven’t signed anything and directly told them after 2 days that this is my current job situation and if I get the job then I cant stay here so you van deduct 10k and give my deposit back. -

March 5, 2025 at 10:27 amI’m highly stressed now. The manager is also not replying to my whatsapp msgs. If they know they are not wrong then they should update in writing right? Also the rental agreement which he shared is of old date from Jan 2025 but i finalised the flat in March
