        A friend of mine is getting a court marriage in a few weeks. His family knows about it, but the girl’s family is unaware. Their plan is to get married legally and then return separately to their homes without informing her family.

        Since court marriages require two witnesses, he has asked me to be one. I’m currently preparing for a government exam, and I’m worried—could being a witness in this situation cause any legal or background verification issues for me in the future? Would this have any impact on my government job prospects?

        Any legal insights would be greatly appreciated!

            If the husband or wife challenges in court that they didn’t get married and other one calls you as a witness to prove they did get married still the only reason you didn’t get the job will because you are stupid.

                This is the reason people avoid being witnesses in cases where there is a chance of one or both sets of parents filing cases.

                    What case can be filed ? Under what section ? If both are of marriageable age there can’t be any proceedings.

                        It is very common in smaller towns. Parents first file a kidnapping complaint to locate their child that has eloped. Upon finding them, the person tells cops they left on their own accord. Now parents do drama and promise a grand wedding so nobody in the samaj says anything. Cops also suggest the person to go with parents politely.

                        Now when the person goes back, brainwashing happens and the whole thing is denied. This is where the witnesses come in because Now the other partner tries to file restitution of conjugal rights and the other side entirely denies it.

                        Even people who undergo kidnap weddings do not often get respite quickly .

                      There’s a marriage registrar, an entry in the register , signature of bride and groom and a certificate. How can anyone claim otherwise ?

                          Anyone can claim anything they want. Proving it is a separate matter.

                                You have the benefit of doubt.
                                Understand that law, and most other subjects you will be studying will have some logic behind them.
                                Think of it like that, and a lot of things will become self-evident.

                              The only way it could affect you would be if the people getting married are minor in age.

                                  Yeah, they’re both adults and following all the legal steps—no child marriage plot twist here.

                                  This is not a movie. A marriage under the special marriage act is solemnised by a registrar and you’re only signing that you know them and the ceremony happened in your presence.

                                  If you’re worried that someone will file a fake case of say kidnapping, that can be filed even if you’re not the witness. In fact as a witness you’re better off since the girl would have signed in front of the registrar. The notice would be there in the registrar office etc.
