        I have mention review of digial marketing comany in uk. And posted bad review online

        and company has mention that since i have got certificate from them and posted it on linkedin.the claim is misleading and false.

        company has mention :

        These reviews contain misleading, false, and defamatory statements

        This contradiction raises serious concerns regarding the authenticity and intent behind your reviews.cause i posted on linkedin i competed the certificate

        and initiate appropriate civil and criminal proceedings against you in a court of law, seeking damages for financial loss, reputational harm, and legal costs.

        Immediately remove all defamatory, misleading, and false reviews from all platforms where they have been posted.
        Cease and desist from making any further defamatory statements against our business in any form.

          Defamation requires a false statement that damages reputation. However, fair criticism based on personal experience does not constitute defamation. Your review appears to be a genuine opinion about the course taken by you, highlighting areas for improvement. Since it does not contain false statements but rather a subjective assessment, it does not satisfy the conditions for defamation.

          You should respond to the legal notice, clarifying that your review is a fair and honest opinion based on your personal experience, which is protected under Article 19(1)(a) (freedom of speech) of the Indian Constitution. You should assert that your statements do not constitute defamation, as they are not false, malicious, or intended to harm the company’s reputation. A firm response will show them that you are aware of your rights and will not be bullied into deleting your fair review.

          Given the complexities of international litigation, costs, and the jurisdictional challenges involved, it is unlikely that the company will pursue legal action against you in India. Even if they initiate proceedings in the UK, enforcing a foreign defamation judgment in India is very difficult, time-consuming, and expensive. Their notice is a deterrent tactic rather than a genuine intent to litigate.

              Section 1, which states that a defamatory statement must cause “serious harm” to the reputation of a business. Given our loss of income and damage to our reputation, this threshold is met.

              Section 2, which provides a defense of truth. However, given that you have publicly displayed your certificate of completion, your negative reviews contradict your own acknowledgment of course completion and cannot be considered truthful.

              Section 5, which allows businesses to hold website operators accountable for hosting defamatory content. If the review platform refuses to remove false and misleading statements, they may also be held liable under UK law.

              Furthermore, your reviews may violate the Bureau of Indian Standards (BIS) Guidelines IS 19000:2022, which regulate online consumer reviews to prevent misleading or false information from being disseminated.
