        I would like to ask if there is a legal way to obtain payslip or other details such as ID card/salary of my brother’s wife’s current job. She is seeking maintanence in court as their RCR case is going for a year now. She dies not live with him anymore. We know she is currently doing a job and earning more than my brother (who is in debt) as she disclosed that to common friend. Our lawyer wants us to get a proof of her employment. We are lost as to how to get it.

          Contact the employer and verify if they have her as employee (in writing)

          Or get them summoned

              How does one summon the employer for information? Are they allowed to share the details of their employees?

                  Talk to your lawyer man

                  He should be suggesting these actions fgs, or replace him

                      Thanks. Our lawyer literally said we must bring the proof. We have to look into getting a new one .

                          You have to bring the proof. Lawyers don’t collect it for you. But they do tell you where to find it. He’s being paid for this counselling.

                        Ask her to submit payslip, ITR statements etc. moreover, same could be verified from her LinkedIn profile, to identify employer + role.

                          Your lawyer seems to be incompetent.

                          He is supposed to make all these prayers to the court to summon payslips from the wife’s employer, affidavit from the wife regarding her income and assets.

                          Change the lawyer if needed.

                          Spend some time online to read case laws as well as case transcripts of various similar cases.

                          Unless you equip yourself with sound legal knowledge, a lot of lawyers might take advantage of that

                            According to the Rajnesh vs Neha judgment by the Hon’ble Supreme Court, in maintenance proceedings, both the Husband and the Wife are required to submit an affidavit in the court disclosing all of their income sources.

                            If she hasn’t done that already or you say that she is lying, contact her employer.

                            If they are not willing to help, pray the court to summon the documents from the employer.
