On March 11, I received an amount of Rs 2000 from an unknown sender via UPI. I raised this with my bank immediately and they said they can only reverse the amount once a formal complaint is raised.

I kept receiving calls from the sender which I initially ignored thinking to be a scam. But later when I picked up, I told them to raise a complaint and the amount would be reversed.

They did the same but their bank said it would take upto 60 days for that to happen. So they called again and requested me to reverse the amount as they were poor and 60 days was a long time. I asked my bank again and they told me that I can reverse the amount on my own if the sender withdrew the complaint.

I told the sender the same thing and they called their bank and withdrew the complaint. They said it would be withdrawn in 48 hours. So, I got the PAN and Aadhar card of the unknown sender and reversed the transaction via NEFT. I also proactively informed my bank by sending all the details via email attaching PAN and Aadhar of the sender along with NEFT transaction details and asked them to treat this as resolved in case a dispute is raised.

Now, cut to yesterday, I saw a lien raised against my account and Rs 2000 (erroneous amount) frozen for the same. I raised a complaint with the bank referencing my previous communication and they said they can’t remove the lien unless the complaint is formally withdrawn by sender’s bank.

Now this leaves me in a pickle as it is not possible for me to make the sender withdraw the complaint. I don’t even know who they are and where in India they live. They already told me that they withdrew the complaint so I don’t think they will take the pain to get it withdrawn again just for an unknown person given that they already got the money.

What are my options here? I have pan and aadhar of the sender, NEFT transaction of the reversal and whatsapp chat confirming that the amount was credited back.

NAL. Did you take a written confirmation when you sent an NEFT amount the unknown sender? I mean you should have an email at-least acknowledging that the sender has withdrawn the complaint with his bank and the amount you transferred to them is received.

If you have such email, share with your bank and tell them to get it resolved with the other person’s bank account. If that doesn’t help then you can approach the RBI ombudsman. However a written communication from that unknown sender is must or at least a recorded call where you have explicitly mentioned to them that you were recording this call.

Additionally, please note that this is not a legal advice. Just giving you some two cents. If any doubt, file official complaint.

          Edit – typos error

Unfortunately no. The sender didn’t appear too knowledgeable about these things. They asked someone on their family to raise and withdraw the complaint and they called me to inform the same. So no written proof of withdrawal.

But I have whatsapp chat screenshot of the person acknowledging that they received the amount back. I am guessing it should mean something.

You are screwed then. The outcome of the lien will be deducting the 2k amount, Additionally ,since you already paid 2k yourself directly to the sender, they will claim they didn’t receive it.

Isn’t NEFT log enough to catch that lie?

Well, the person can say that they had lent you some money via cash some xyz days ago and you are just repaying it.

You made a mistake by reversing it yourself. You should’ve let the bank handle it. You’re going to lose the other 2k as well.

Even if I have evidence that I reversed it and the written WhatsApp confirmation from the sender that they got it?

If I’m not wrong, your next step should be that you were scammed into sending 2k to this person. That way, their account will be marked lein with 2k. Given they have enough balance in the account.

Then that guy will probably approach you to resolve it.

But here’s a bummer, I don’t think they’d have more than 100ish balance in that account.

All the crying was fake or a third person in the middle who is also actually a victim.

How do I know this? I have investigated a bunch of similar scams at work. And my family members have also been scammed. And I chased it in various ways. In the end the person I found was also innocent, he was just being used by the scammer.

There’s a very thin chance this is all legit.

Here’s one more bummer, police will laugh it off when they hear the amount.

That’s unfortunate. The only thing for me to do now is to think that I did charity of Rs. 2000. But what is concerning me is the lien. How do I get it removed? Should I ask my bank to just deduct the amount and remove it? Will it impact my credit history?

No it won’t impact credit history. Such cases are so common nowadays that cyber crime police orders freeze and lein upto layer 6 (max I’ve heard so far) i.e. 5 hops down from the actual scammer account. A tea vendor near my home had a lein of 55 because someone paid him for tea. Guy who paid for it also didn’t know he had tainted funds in his account.

If bank is able to reverse it. Let them do it in their own time. It’s for the better that that specific amount is lein. And your account with rest of the funds is still operational.

No he won’t if he has proof that he sent that amount back to sender already this will get resolved fairly easily, it’s just the backend system of banks is a bit slow

This is why you never do reversal… ask them to go to their respective banks

Irrespective of any lien, banks cannot just debit from your account because someone asked them to.

Don’t worry, after a few days the bank would approach you to ask if you’re fine to reverse the transaction, you can deny it then.

They did not debit. They put a hold on the 2K amount. I emailed them asking to release the hold as I have already paid the amount back but they said they cannot until the complaint is officially withdrawn.

I had a similar experience but with a larger amount. Despite sending multiple emails and visiting the nearest branch, the issue wasn’t resolved immediately. The team assured me that the backend team was working on it. However, the lien amount was eventually reversed to my account after 60 days. You might want to wait for a similar timeframe, and your amount should be automatically reversed.

Since you have proof of the reversal via NEFT, including the sender’s PAN and Aadhaar details used for the NEFT, along with the transaction confirmation, you should formally complain to your bank again in writing like email or letter attaching all this evidence and detailing the entire sequence, including your initial contact with the bank and the sender’s request. Clearly state that the funds were returned and the lien is erroneous. If the bank branch remains unhelpful or insists on the sender withdrawing the complaint. Escalate the matter through the bank’s official grievance redressal mechanism like the nodal officer and, if unresolved within 30 days, file a complaint with the Banking Ombudsman, presenting all your documentation as proof that the disputed amount was already returned to the original sender.

Thanks. This sounds promising. I have the required documents including PAN and aadhar of the sender , bank account details as well as confirmation from them that they received the amount. I will file a physical complaint if my online complaint doesn’t work.

OP, why didn’t you just send 2k back to the sender via UPI? Why get the bank involved at all?

You also file a complaint. Bcz you also sent the amount.
